Acting Supervisor of Elections, Ana Mataiciwa says her referral of the complaint against Deputy Prime Minister and National Federation Party Leader, Professor Biman Prasad to FICAC was not only within her statutory rights as the Acting Supervisor to act on the complaint but equally under her statutory duty to refer the matter.

In response to the allegations made by the Professor Prasad, the Acting Supervisor Mataiciwa reiterates Section 18 of the Electoral Act 2014 which states that if the Electoral Commission or the Supervisor becomes aware at any time of the probable commission of an election related criminal offence including any criminal offence prescribed in the Act, it must immediately report the matter in writing to FICAC, and all election officials must fully cooperate in the investigation of any election related offence.

Mataiciwa says her office received the complaint, the complaints process was followed, and after assessment, powers under Section 18 of the Act was invoked, requesting FICAC to investigate a 'probable' breach.

She says this must not be misconstrued as finding Professor Prasad guilty of any offence.

Mataiciwa says this underscores her dedication to upholding independence, electoral integrity, and transparency.

BIMAN PRASAD, disregarding the tender process, handed $200,000 of taxpayers money to the defunct Global Girmit Institute, run by his WIFE and his chamcha GANESH CHAND, who organized Girmit celebrations. He is accused of a slew of other electoral breaches, now with FICAC.
*We are still waiting for Prasad to produce the audited account of how $500,000 was spent during Girmit 'party'.

Tikoduadua claimed that since those text messages on 'bonking and weed taking' in Room 233 at Windsor Hotel in Melbourne (he was part of the Whips conference) was obtained illegally (meaning by Fijileaks) the allegations against Tabuya are 'baseless'.
We repeat that they were not obtained illegally, and the text messages are authentic and Tabuya must be stood down from Parliament, and her conduct referred to Fiji Police.

I am writing this letter to lodge an official complaint regarding one Biman Prasad who is the Party Leader of the National Federation Party which is currently in the Coalition Government.

I note that Biman Prasad has declared that his income being $188,000 per annum, however he failed to declare the FNFP contribution as it added on top of his salary under the Parliamentary Remuneration Act 2014, excluding his personal contribution as required by law (Attached as exhibit 1- Parliamentary Remuneration Act 2014). I state the following:

1. Under section 24 (1)(A) (B) (i) which stipulate one must declare total assets whether in Fiji or Abroad (including money and other property) in their possession or under their control. Therefore, I argue that FNPF contributions and any funds is considered personal property as one can have access to funds as stipulated in the withdrawal provisions of the fund being FNPF. Therefore, Biman Prasad should have declared his contributions and the amount held by FNPF. I note the case precedent used by Aiyaz Sayed Khaiyum whereby in one of his previous declarations he declared his FNFP declarations. Therefore, the same must apply in this case.

2. I note that Biman Prasad failed to declare his travel allowances during his overseas travel and the amounts he received. That evidence is in office and can be verified upon your perusal of his declaration.

3. I noted that Biman Prasad failed to declare that he is the Governor of the Asian Development Bank in Fiji. As that position is not Gazette to him under the Parliamentary Remuneration Act 2014 it is thus separate to his Minister of Finance Post- which must be declared under section 24 (1) (ab) (iv) of the Political Parties Act where a person must declare any directorship or other office in a corporation or other organisation whether in Fiji or Abroad held by each of them. In support I attach exhibit 2- Asian Development Bank Documents stating that Biman Prasad is Governor of the Reserve Bank.

4. I note that Biman Prasad did not declare that his wife one Dr Rajni Chand is the trustee of the Global Girmit Institute and that it facilitated the funds of $200,000 given by the Coalition Government. The Not for Profit Organisation was re-registered in 2023, after it deregistered in February 2022 for failing to supply its financial statements as required under the laws of Fiji. The period of re-registration falls within the required period upon which Biman Prasad is required to declare in his 2023 Financial Declaration (Attached is exhibit 3- Global Institute Deed of Trust and
Registration Documents).

5. I note that Biman Prasad did not declare his connection to Ganesh Chand and Hirdesh Sharma whom are the registered Trustees of the Global Girmit Institute upon whom received $200,000 of Tax payers funds. This is a breach under section 24

(a) (b) (iii) of the Political Parties Act. I submit that no tender was called in relation to the event organisation.

6. I note that Biman Prasad declared that he owns 50 percent shares in Lotus Construction Pte Limited, however upon obtaining the registration documents and the Article of Association – it was established that Biman Prasad only has a 5 percent share in Louts Construction and not the 50 percent share he claims in his declaration (Attached as exhibit 4- Lotus Construction Pte Limited Registration Documents and the Article of Association).

The document was re-lodged in 2022 with the date of the Article of Association dated and signed in 2014 and upon which the re- registration occurred in 2022.

7. I note that one of the directors of Lotus Construction upon which Biman Prasad has shares in is Sunil Chand (Please refer to exhibit 4). Biman Prasad did not declare the business connection with Sunil Chand who has the same Lotus Construction company in Australia thus being a breach under section 24 (a) (b) (iii) of the Political Parties Act 2014 (Attached is exhibit 5- Louts Construction registration in Australia).

8. Biman Prasad’s spouse Dr Rajni Prasad [Chand] did not declare that she is Chairperson to Femlink Pacific (Please note she has held this position 2009 to date), therefore being a breach under 24 (1a) (d) of the Political Parties Act (Attached is exhibit 6- Femlink Document stipulating that Dr Rajni Prasad is the Chairman of the organisation). Dr Rajni Chand may/may not be receiving a salary from this post nonetheless it was a non-declaration.

9. I note that Biman Prasad and Dr Rajni Chand have not declared under section 24 (1) (a,b (iii) and 24 (1A) (c) of the Political Parties Act 2014 their business transaction to one Dr Ganesh Chand who is the co-trustee of the Global Girmit Institutre as previously mentioned. However, due to the business transaction the fact must be taken into account is that Biman Prasad allocated $1 million to Pacific Polytech whose Advisor is Dr Ganesh Chand. Please note that there was no tender process in line with the Laws of Fiji. Please note that Pacific Polytech has not submitted that their Audit reports as required. The funds was transferred in 2022 to Pacific Polytech.

I therefore submit this complaint for the breaches under the Political Parties Act 2014 upon which I understand that whilst some elements of this complaint cannot be handled by your office.

You must, therefore, refer the matter to FICAC under section 18 of the Political Parties Act.

*Since Biman Prasad never responds to our questions, we decided not to obtain comments from him regarding the allegations to the acting SOE.

2. Did the USP charge the GGI to host the conference, and if so, how much will be billed to the GGI?

3. What is the explanation for such a magnanimous gesture if it was free?

4. What action will USP take against Rajni or will you launch your own separate inquiry into her association with the Global Girmit Institute?

Minister for Home Affairs, Pio Tikoduadua says they are working with our development partners to build a specialised Drug and Narcotics Bureau. While elaborating in parliament, Tikoduadua says this new bureau will be tasked with the effective intelligence gathering, prevention and the prosecution of those who are responsible for this threat to Fiji. He says the illicit drug trade in our country threatens the very fabric of our society as it is not simply a criminal enterprise but it is a multifaceted scourge that undermines our social, economic, and moral structures, with a particularly devastating impact on our youth. Tikoduadua says the infiltration of drugs into our communities has far-reaching consequences. He says the drug trade erodes the potential of our young people, drawing them away from education and productive activities into cycles of dependency and despair. He says the drug trade, with its false promises of quick wealth, ensnares not just individuals but entire families and communities, perpetuating a cycle of poverty and lawlessness. Tikoduadua stresses that the government is acutely aware of the gravity of this issue and the need for a comprehensive and multi-pronged strategy to combat it.

TIKODUADUA, start by reporting your Cabinet colleague, Womens and Childrens Minister and Social Protection LYNDA TABUYA who accompanied you to Melbourne, to Fiji Police, and order that the Police seize her Coalition government mobile phone to establish how she was able to smuggle 'weeds' into her Room 233. Jumping to her defense, you claim the text messages were obtained illegally, meaning the text messages are authentic. Please start by calling on the POLICE to arrest and search Tabuya's mobile phone.

Due to legal technicality, divorce was not granted, and the couple remained married when she re-married in August 2022, with you posting a 'congratulatory message' on the marriage.

It is alleged that Turaga, while in private legal practice, took over Mrs Mikaele Lewaicei's divorce application case on 27 July 2022 and on 6 August 2022, she got married in California to a fellow i-Taukei without being granted a decree nisi* from Fiji. In fact, no divorce was granted in Fiji, and Mr and Mrs Lewaicei still remain married under the laws of Fiji. How Turaga's former legal client got married is now the subject of a Police case after Mikaele Lewaicei filed a police complaint.
It is against the law to marry someone else while you are still legally married and going through a divorce. This means that getting remarried during a divorce process is not allowed in any of the 50 states in the United States, as it would be considered entering into a new marriage while already being married to another person.

The Fiji Police, with assistance from their counterparts in Sacramento, San Francisco, are investigating a criminal complaint from former soldier MIKAELE LEWAICEI against Attorney-General SIROMI TURAGA who stands accused of facilitating the marriage of his 'village cousin' from Nairai to another man while she remained married to Lewaicei.
It is alleged that Turaga, while in private legal practice, took over Mrs Lewaicei's divorce application case on 27 July 2022 and a month later, on 6 August 2022, she got married in California to a fellow i-Taukei without having a decree nisi from Fiji. In fact, no divorce was granted in Fiji, and Mr and Mrs Lewaicei still remain married under the laws of Fiji.
Turaga had fallen foul with the Bainimarama-Khaiyum regime as resident magistrate during Covid-19 when he had acquitted two men of breaching a curfew. He had ruled that the charge was defective as Prime Minister Frank Bainimarama had no power to order arrests under the Public Health Act.
His contract was not extended. He went into private practice, and later stood as PAP candidate in the election, and was appointed Attorney-General after PAP formed Coalition with SODELPA and the National Federation Party.
According to a police statement cited by Fijileaks* from Lewaicei:

Fijileaks Update: A further search revealed that an application for divorce was filed in the Lautoka Family Court but allegedly not by Turaga.
According to court sources, it was sent via post from the United States by Mrs Lewaicei but the matter was struck off because both the parties did not attend. Mikaele Lewaicei was not aware of the divorce application nor was he informed. He was serving in the Sinai. He is the son of the former Police Commissioner, the late Josefo Lewaicei.
What role, if any Turaga played, await a detailed response from him.

California Penal Code 281: Bigamy Legal Definition:
Every person having a spouse living, who marries or enters into a registered domestic partnership with any other person, except in the cases specified in Section 282 , is guilty of bigamy. PC 281 does not extend to any of the following:
(a) To any person by reason of any former marriage or former registered domestic partnership whose spouse by such marriage or registered domestic partnership has been absent for five successive years without being known to such person within that time to be living.
(b) To any person by reason of any former marriage, or any former registered domestic partnership, which has been pronounced void, annulled, or dissolved by the judgment of a competent court.
What does this mean? It is a crime in California for a person, already married, to get married to another person. It is also a crime to marry a person that is already married. Commonly, people will attempt to divorce but never finalize the legal paperwork for one reason or another.
People can live separately, not talk to each other, and believe that they are somehow divorced.
After this separation, the same person marries again without realizing that the divorce from their first marriage was never finalized (due to a lack of formality). In that case, they have committed bigamy.
Penalties
*Bigamy is a wobbler crime, meaning it can be charged as a misdemeanor or as a felony, based on the level of the deceit, your criminal history, and the specific facts of your case. If you are convicted of this charge as a misdemeanor, you could be sentenced to up to one year in County Jail.
If you are convicted of this offense as a felony, you could be sentenced to upwards of 16 months, two or three years in State Prison.

LYNDA TABUYA must be sacked from People's Alliance Party and from the Parliament of Fiji. She broke the Ministerial Code of Conduct and has brought irreparable harm to the image of Fiji by snorting weed, downing Jack Daniels, so she could be brutally bonked by Sodelpa's then Education Minister Aseri Radrodro, the father of Rabuka's grandchildren.
Prime Minister Sitiveni Rabuka's past mistakes regarding women are an irrelevant consideration, as a public servant and current occupant of the Prime Minister's Office, his decision must be based on upholding public integrity and principles of good governance.
Surely, he should realise that saving Tabuya, will make a mockery of the dignity of his high office and Cabinet, and will take him and Tabuya both the slippery slope of disgrace and dishonour.
It may also cost the People's Alliance the next election.

We stand by our decision to reveal the text messages between Tabuya and Radrodro, whether they were obtained legally or illegally.
The text messages are AUTHENTIC, Fiji.
We also call on PIO TIKODUADUA to resign, for shamelessly defending Tabuya. As part of the Whips delegation to Melbourne, did he HEAR orgasmic screams coming out of Room 233, for the sex was so brutal that Tabuya told Radrodro that she could barely walk next day.
If Fijileaks had decided NOT to release those text messages, we would never have known what the two Coalition Cabinet Ministers were up to in Room 233, while the Minister's wife was asleep a few rooms away.
After all, they were attending the Role of Whips in Politics and Government conference
