A costly 'blunder'

LAST week the Minister of Finance, in a letter published in full in the Fiji Sun, replied to the concerns of the Association of Banks of Fiji about the new Fair Reporting of Credit Act.

Like all of his other statements regarding this Act, which has come into force from April 29, the reply is full of incorrect information and irrelevant sidetracking. Spin and diversion is not going to change the facts.

First, the minister accuses ABIF's chairman, Mr McCarthy, of a "conflict of interest". This is because Mr McCarthy is the head of BSP Bank and BSP Bank's associated company, BSP Life, is a shareholder of Data Bureau.

This is just plain silly. Is the minister suggesting that the BSP Bank should not do any business with the tourism industry because BSP Life has shares in a large Denarau hotel?

Is he perhaps suggesting that every Parliamentarian whose relatives had a listing on Data Bureau's files should have declared their interests before voting?

The minister has made a blunder. This Act will do harm to many people in Fiji in a very unfair way. It will effectively close our business. There has been no consultation with our company or the people who use its services.

The minister seems to think it is Data Bureau's fault that there is no regulation of credit reporting in Fiji.

In fact, we have worked with organisations such as the World Bank to develop the best and fairest systems of data collection and recording.

Our rules most certainly protect people's privacy. They also provide for quick and confidential correction of any errors which are made.

The minister makes vague allegations about having received "many complaints from members of the community regarding information held by Data Bureau".

That is a meaningless statement. He does not say if he has investigated the complaints or even established if those complaints are justified.

As of last month Data Bureau held 415,275 consumer files and 91,729 business files. There have been 1,141,109 consumer searches and 26,855 business searches in the past 15 years, and 7870 public notices.

Mrs Premila Kumar of the Consumer Council of Fiji said the council received 47 complaints. Only 14 complaints from the Consumer Council have reached Data Bureau in 15 years.

Data Bureau responded to every single Consumer Council complaint and the council took no further action.
Mrs Kumar has been to our offices. We have explained to her our processes, how we protect people's privacy and how we correct errors. She has never once suggested to us that our systems are wrong or need improving.

The majority of Fijians have no adverse credit history. If a credit provider inquires about a person and is told that a person has no adverse records at Data Bureau, that helps that person to get credit more quickly and at better rates of interest. So the majority of people will lose as a result of this Act.

The minister seems to be under the delusion that, as a result of the new Act, there will be a new credit bureau and it will have perfect information.

The minister does not seem to understand the basics of a credit bureau.

It is about a history of credit information, obtained by consent and shared by the majority of credit providers, who make their own credit decisions.

The key word is "history". Data Bureau had 15 years of history. If there is no history then there cannot be a useful credit bureau. If the minister had engaged in some meaningful consultation he would have understood this.

Lastly, I need to once again correct the minister on several points:

* Data Bureau's information is not flawed, or as he says, "tainted". Just because the minister says he has received "complaints" does not make it so. He has produced no evidence of his so-called "complaints". Just assume (even though it is not true) that the Consumer Council was correct in its 14 complaints about our 415,275 consumer files. Is that a good reason to throw away the other 415,261 files;

* Many government departments and statutory bodies are customers of Data Bureau. They have never complained of "tainted" information;

* Some people seem to think that if they take a long time to pay a debt, but they finally pay it or settle it, that they should not have an adverse record at Data Bureau. Ask anybody in business who has ever spent valuable time chasing bad debtors, or paid legal fees to lawyers or had to discount an invoice to get payment. Why, with a bad credit history, should a person get credit on the same terms as someone who has honestly and diligently paid all his or her bills on time;

* All information contained on our database — other than public information such as court judgments — has been collected with consent. People seeking credit from a credit provider give consent because they know that a Data Bureau search gives confidence to credit providers;

* Sometimes an adverse record appeared and people objected to it. If the record was wrong, it was quickly and confidentially corrected. Data Bureau had a process for this. But how can people object to information which is true, and which they have agreed that Data Bureau may have;

* The minister says that he is "perplexed" about news that interest rates may rise as a result of this Act. He says "a decrease in interest rates was not touted as a reason for the introduction of the Data Bureau." In fact, they were. And the evidence clearly shows that these two benefits have occurred; and

* Of course we cannot show a direct correlation between interest rates and the existence of Data Bureau in the past 15 years. Interest rates are affected by many things. The minister was also once a lawyer for a bank. And therefore he must surely know that when, because of a lack of information, a credit provider's risks of loan default increase, the cost of credit — that is, the interest rate — will also decrease. How else will a credit provider cover its losses?

We will shortly be updating our website to include all statements made by any minister and the Consumer Council regarding this new Act together with our comments and corrections. The public will then be able to judge who is right and who is wrong.

So, on what grounds was Khaiyum allowed to enter the United States to sign loan agreements with the World Bank? Minister for Women, Children and Poverty Alleviation Rosy Akbar says she is saddened by comments on domestic violence by Speaker to Parliament, Dr Jiko Luveni.

During the Rishikul Sanatan College Professional Development Programme held in Nasinu on Tuesday, Dr Luveni said that women sometimes aggravated a situation of domestic violence.

Ms Akbar said such comments were inappropriate. She reiterated that the ministry did not tolerate or condone any form of violence against women and children or anyone.

“I believe there is never any excuse against violence.”

She said victim blaming attitude was a barrier that placed survivors in great danger.

“Victim blaming attitude actually marginalizes victims. It makes it harder on them to come and report such cases of abuse because as a survivor or as a victim you may feel that the society blatantly blames you for the abuse or the violence that is inflicted upon you.”

She added that by engaging in victim blaming attitude “we will only allow the abuser to perpetrate relationship abuse while avoiding accountability for his or her actions.”

Ms Akbar acknowledged that while Fiji may have one of the best laws to curb violence against women and children, community leaders needed to work together.

“We all need to work together to see how best we can protect – not only our women and girls but also our children, our elderly, our disabled and all vulnerable group.”

Ms Akbar is determined to continue the fight with the assistance of enforcement agencies like Police and civil society organizations.

She is also calling on all stakeholders to be responsible and to be mindful about what is said about an issue that is at the top of our national priority. Source: Fiji Sun

Ministry uncovers fraudsters

ABOUT 22 per cent of those who have benefited from Government's "Help for Home" initiative were found to have given false information in order to receive assistance to rebuild homes damaged by Severe Tropical Cyclone Winston.

This was revealed by Ministry of Finance's Luke Koroisave, who said they had referred some cases to the police following the investigation carried out by their audit teams.

He said some were found to have received two to three prepaid electronic cards — meaning they received more than one payment.

Mr Koroisave said some had also deliberately changed their address from living in settlements to living in the village in order to qualify for the $7000 payout.

Those living in settlements, whether squatters, vakavanua settlement or in areas outside the village boundaries were to receive $1500 as per the guideline set out by Government.

He said they had also received a report from Vodafone Fiji, which was responsible for the electronic cards, indicating that some were in possession of two cards. According to Mr Koroisave, they were able to find out after advisory councillors in the village, who were representatives of Government, revealed that some of the listed recipients' houses were not damaged by the cyclone.

Some names were also not on the list and those, he said, would be revisited by the military engineers to have their houses assessed again.

Mr Koroisave said some people had left their villages to live on farm houses and requested for assistance to both houses.

He said people should be reminded that they could not escape the law and the law would definitely reach out to them whether this year, next year or right in 2020 because Government would send out a team to assess how the money was spent. Owners of houses with partly damaged roofs received $1500 and if the roof was completely blown away, $3000 would be paid.

The $7000 payout was for houses of which the walls and roofs were damaged and those completely destroyed.

(2). A lot of commentators seem to think it's a Kadavu expression, which it may be, but it's also Standard Fijian, though maybe not much used among the younger generation

An e-mail dated 15 May 2016 from Bulitavu to Vakatora reveal the on-going spat over NFP leader Biman Prasad's removal as PAC chairman. Bulitavu to Vakatora:

* Tom, we all know that AG twists things to fit his agenda.
* Why rely on his statement?
* We all know that he has misled public many times and why we use his statement as evidence to investigate Hon. Aseri.
* It will be silly that Sodelpa will use its enemy statement to trial a comrade. Politicaly FF will be laughing that they have influenced/forced Sodelpa to react.
* I hope Tom will reconsider his stand and weigh the effects of what will manifest. As said earlier that both AG and Hon. Biman are not Sodelpa members.
* Even the Leader of Opposition agrees that Hon. Biman "e tamata rere" which means that he was evading the more serious allegations cited by the Auditor General's Report.
* Our focus now must be how to influence PAC under the new Chair. The issue of the old chair is now split milk. The amendments to the Standing Orders was voted in the house and Hon. Aseri voted against the motion.

While I have kept away from commenting on the issues surrounding the Fiji First Government’s disgraceful decision to remove Professor Biman Prasad as chair of the Public Accounts Committee, I thought I should set the record straight in light of some comments in social media, including Fiji Leaks.  Hon A Radrodro, has referred to me in this controversy.


I confirm that in my final submission to a SODELPA disciplinary committee I referred to remarks to the Parliamentary Standing Orders Committee by the Attorney-General, the true leader and mastermind of the Fiji First government. He had referred to Hon Radrodro complaining to the Fiji First side about Hon Biman Prasad's chairmanship of the PAC.

The source of my information were verbatim notes which I attach for your perusal. The AG's reference to Hon Radrodro is clear. If Hon Radrodro disputes what the AG said, than he needs to take aim at the AG and call him out on it to clear the air on this matter and his name.

"The complainant was a 14 year old school girl at the time of the incident. She was one of 18 students in a classroom sitting an examination. The appellant [Maika Bolatiki] was supervising the examination. The complainant was sitting at a desk in the front row. She said that the appellant came and stood beside her on her left. She looked up and the appellant touched her breast with his left hand. She sat up and the accused slid his left hand down her stomach and right to her private part. He then rubbed her private part. He denied touching her breast or private parts. However, the actions of the appellant as described by the complainant in her evidence were something that would not necessarily have created attention. The other pupils in the room were writing their examination papers. The Appellant was standing alongside the complainant in the front row and such conduct would be expected to have been done as surreptitiously as possible...The learned Magistrate made a clear finding that he accepted the evidence of the complainant as truthful. An appellant Court would need very compelling and cogent reasons to interfere with that finding. There are no grounds to do so in this case...The appeal against conviction is dismissed"

Dr Luveni stresses that she does not condone violence against women

Speaker of Parliament, Doctor Jiko Luveni stressed that she does not condone violence against women and is also not blaming women for domestic violence cases.

Doctor Luveni has made this clear to Fijivillage after calls made by some women’s NGOs for the Speaker to apologize to the women in Fiji for saying that women should not aggravate the situation at home when they deal with their partners.

Doctor Luveni said she would never say that it is right for men to beat up women or children. Doctor Luveni said the full context of her presentation needs to be understood. She said that she was focusing on how everyone can prevent domestic violence. Doctor Luveni said the realities need to be understood and she is not blaming women for domestic violence. ONE MORE ON THE CYCLONE WINSTON RELIEF CIRCUIT - in Singapore

Former Fiji businessman Mohammad Salamat Ali has launched his own appeal for Cyclone Winston relief money - in Singapore.

Ali boasts of a ten-year stint as chief executive officer of JRA Fiji Ltd.

In his Linked-In profile he says he has “ignited some of the most successful brand launches, continuity and re-positioning assignments for brands including Fiji Water, Vodafone, Nestle, Colgate, Coca-Cola, Total, BP, Shell, Digicel, Toyota and others.”

He does not, however, list his association with the SDL for whom he helped run the successful  2006 election campaign. Nor does he list his association with serial conman Peter Foster who had something to say about him in a previous Fijileaks report.

He has now launched his own worldwide Cyclone Winston appeal at a function attended by a Fiji TV crew (he paid for their travel) and former president Ratu Epeli Nailatikau in Singapore.

He gave no indication of how or if the funds he collects will be accounted for.
