ELECTING to STEP DOWN, Finally. Six months ago Fijileaks confronted Electoral Commission chair SURESH CHANDRA with evidence of alleged misuse of Trust Funds and asked how can we trust him with Fiji elections

20/11/2021

Fijileaks: We had, privately, put to Chandra and copied to Election Minister Aiyaz Sayed Khaiyum and Supervisor of Elections, Mohammed Saneem, that his (Chandra's) legal firm had misused clients trust account funds without the approval of his clients to the tune of $2million. Chandra blamed a legal staff member and a bank officer for the alleged fraud, and reportedly sold a property to try and settle the missing $2million. He didn't report the matter to the Fiji Police nor stepped down as chair, Electoral Commission, thoroughly compromising the Elections Office. We also challenged him to explain why his name was missing from the Legal Practitioners List.

NFP's 'ELF' NEEDS AN EDUCATION IN POLITICAL REALITY

LOST THE POLITICAL PLOT
The NFP 'ELF' Phd STUDENT  and his COUPIST HANDLER
TEACHER
Both refused to sign the three parties letter against Electoral Commission chair, SURESH CHANDRA. Politically, HANG these two parties at the 2022 election from a MANGO TREE, for covering up FRAUD. After all, the trust funds belonged to the legal clients, just as the National Bank of Fiji money belonged to Fijians of all races. And here are the TWO leaders asking us to
TRUST THEM in 2022

COMMENT: On 18 November three parties - FLP, Freedom Alliance and Unity Fiji - wrote to the chairman of the Constitutional Offices Commission (six months after the Fijileaks posting) demanding CHANDRA be removed, 'we firmly believe from information made known to us that he (Chandra) should be immediately suspended from office and referred to a Tribunal to be investigated for gross misbehaviour'. Now, Chandra has resigned as Chair, Electoral Commission, without providing any reasons for his abrupt resignation. Supervisor of Elections MOHAMMED SANEEM says Chandra's decision was a SHOCK to him. Really? Six months ago both, his Master, Election Minister AIYAZ SAYED KHAIYUM and the 'House Elf' Saneem had contemptously ignored Fijileaks questions. Disgustingly, another bloody 'Elf' - NFP leader BIMAN PRASAD refused to sign the letter with the three parties, preferring to side with COUPIST and People's Alliance leader SITIVENI RABUKA. Come election 2022, KICK both these political traitors into the dustbin of history. We had, privately, put to Chandra and copied to Khaiyum and Saneem, that his legal firm had abused clients trust funds to the tune of $2million. Of course, Chandra allegedly blamed a legal staff member and a bank officer for the fraud, and sold a property to try and settle the missing $2million. He didn't report the matter to the Fiji Police nor stepped down as chair, Electoral Commission, thoroughly compromising the Elections Office. We also challenged him to explain why his name was missing from the Legal Practitioners List. We can understand why Rabuka was not party to the letter, for after all, he was responsible for the looting of the National Bank of Fiji to the tune of over $275million

FLP, Freedom Alliance and Unity Fiji to Chairman of
Constitutional Offices Commission:
"Under s75-(6) of the Electoral Commission consists of a chairperson who is, or is qualified to be, a Judge and 6 other members. The fact that the chairperson must hold the qualifications of a Judge requires the appointee, at all times, to uphold high moral standards and integrity in public life. It is in this regard that we are constrained to write to you about the incumbent chairman of the Commission, Mr Suresh Chandra We firmly believe from information made known to us that he (chandra) should be immediately suspended from office under S137-(4) of the Constitution and, referred to a Tribunal under s137-(3) (a) (i) to be investigated for gross misbehaviour.'

"In the case of the AG, there were allegedly complaints by female members of his staff that he was in the habit of summoning them to his hotel room while travelling overseas and asking them for massages. While these were said to be of a non-sexual nature, it evidently caused enough discomfort for the women to raise the issue at a higher level. As with other celebrated cases in the “Me-Too” era, it is the disparity of power and the ability of an employee to say “no” that is the issue, as well as whether the alleged approaches were appropriate.  It is believed that complaints made by the women in question to the former deputy solicitor- general, Tracey Wong, were a significant factor in Wong’s subsequent resignation. She was reportedly sidelined and cold-shouldered when she took it upon herself to raise the issue with the AG – an episode that doesn’t sit well with Khaiyum’s carefully crafted image as someone who empowers young and ambitious women in his office. He prides himself on hands-on government. Occasionally someone else’s hands, it seems." - Graham Davis, Grubsheet, 18 November 2021

KARMA IS A BITCH, Sharvada Sharma: 'We call on the Fiji High Court to FINE Fiji Times $500,000 and its Editor jailed, for Contempt of Court. The Fiji Times is repeat offender.' Fijileaks: 'But Give Sharma Natural Justice'

17/11/2021

Picture

COMMENT: SHARMA DESERVES NATURAL JUSTICE
If it is true that sacked Solicitor-General SHARVADA SHARMA was suspended without pay then this is definitely against current  public service practice based on the Public Service Act and Public Service Regulations. An officer in the public service can only be suspended without pay if he has committed an offense of serious criminal nature and is served with appropriate  disciplinary charges in writing from the day his or her suspension commenced. In Sharma’s case, he was entitled to continue to be paid his full salary and perks from the 20th September until he had been formally charged in writing. We don’t think the sets of questions that the police handed to Sharma on 4th November from the Judicial and Legal Services Commission(on the basis of Sharma’s response, the JLSC would then be able to frame disciplinary charges against him) could even be considered as constituting formal disciplinary charges against Sharma?
So Sharma was entitled to continue to receive his salary and perks even beyond 4th November. Surely, the officer appointed to act as Solicitor-General would have some prior understanding of these basic management principles or she would have at least checked it out with the Permanent Secretary of the Public Service Commission before taking action against Sharma. But we suppose since her Minister is also Minister of the Public Service Commission, she  would have very little options but to carry out her Minister’s  politically- biased directives.
We hope one day the Opposition will  have the stamina to raise this serious matter of conflict of interest in the House where Cabinet portfolios are allocated “on the basis of who you know" to individual Ministers. In this case the Minister of Everything, regardless of potential areas of conflict of interest and abuse  of office. He is the ultimate judge of the public service, public purse or the budget, the judiciary and the law.
In good old days, civil servants who were suspended and served with disciplinary charges in writing were given up to 14 days to respond in writing to the charges. We, therefore, are shocked to learn that Sharma was only given 2 days to reply to the list of questions he was given on November 4, which leads us to assume that the communication from the JLSC
did not in any way represent any formal disciplinary charges against Sharma.
Having said all and warts, there is no denying that Sharma was a crucial cog in the setting up of the legal machinery to advance and consolidate FFP power.

Yes, SHARVADA SHARMA, as Indian sadhus say: 'KARMA IS A BITCH'.

As the Fiji Times court saga revealed, FFP was happy with Sharma as long as he was FijiFIRST PARTY's 'Son of a Bitch', pursuing and convicting Fiji's 'Sons and Daughters', who dared to stand up to FFP.

"HE [Aiyaz Sayed Khaiyum] has been mass producing cheap quality  but highly toxic decrees from his ASK Decree Sausage Plc machine without any democratic production license to do so, and ordering voiceless Fijians to swallow them without uttering a word of protest, and blocking access to courts for redress. Two of his illegal workers employed to operate the decree machine are Kiwi Christopher Pryde, and his side-kick, the Indo-Fijian Sharvada Sharma from S-G's Office. He has been playing Godfather with the Casino Decree; Lord of the Sea with the Surfing Decree, to name a few. Now, it has emerged that many of his decrees are objectionable, defective, and plainly unacceptable. The Yash Ghai chaired Constitution Commission has stripped them bare to the bone, like the cartoon  "Borat Fiji Mankini" and he has been brought to ground. No wonder, he has confiscated the Draft Constitution, and all other supplementary documents presented to Ratu Epeli Nailatikau.
But you can read them now.
Meanwhile, we will let the Commission speak to you through its
Analysis of Decrees post 2009:"

TESTIMONIALS for Teachers Without Degrees: 'Both my parents were school teachers. My DAD taught for 34 years and my Mum for 40 years. They retired as Head Teachers. They didn't have Degrees.' - SUDHAKAR

16/11/2021

A PROFESSOR with University Degree can't smell COUPIST and CONMAN
But, then, one can't twist ears of an educated 'ELF' to speak sense to him. In 1987, hundreds of Indo-Fijian educators, with or without degrees, lost their jobs, and many fled abroad from Rabuka's racist cycle of terror. Many Indo-Fijian female teachers in rural areas had to hide from Sitiveni Rabuka's marauding horde of RAPISTS. Some were forced to strip naked, cassava was shoved into their vaginas, and they were told to cook naked for their vile tormentors.

A very close young relative of our Editor was snatched from outside the Nasinu Teachers College, RAPED, and dumped in the Rewa River. To date, we don't know if she was already dead or still alive when Rabuka's rapists and kidnappers dumped her in the river. Her decomposed body was found by i-taukei villagers after two weeks. RIP. Coupist is not only hiding under the sulu of Immunity but has now formed his own political party, the so-called 'People's Alliance', with 'Professor Elf' greasing his political balls, desperately hungry to share POWER with him in 2022

Nasinu Teachers College was established in 1947 following the 1946 Education Plan after World War II. There was a need to further enhance the educational needs of the locals and this meant the replacement of small mission and government teacher training colleges with a large government college Nasinu Teachers College. The institution was built specifically to train teachers. The establishment of the Nasinu institution resulted in a marked improvement in the quality of primary school teachers, and in 1982 it underwent some changes and re-opened as the Nasinu Residential College for students. Later in the 1990s, an Australian Aid programme helped establish training for secondary teachers and in 1992 the College was renamed as Fiji College of Advanced Education (FCAE).  In 2010, FCAE became part of the Fiji National University under its College of Humanities and Education. All the participants worked as teachers in schools around the country and then progressed to climb higher ranks in the civil service while some migrated overseas later in their careers. Fijileaks: The NFP's 'Elf' and (PROFESSOR EMERITUS) didn't name British High Commission in Fiji. Somebody who retires from a Professor position is often referred to as Professor Emeritus, and so (in some sense) gets to keep their title. PRASAD is no longer PROFESSOR

“Furthermore, the decision of a diplomatic mission here to fund the trips of journalists of only two news media organisations is also highly questionable”.

“One organisation is State-owned and has been provided more than $80 million in grants in the last decade. The other enjoys exclusivity in terms of government advertising”.

“Was the fact that both are heavily funded by taxpayers funds through grants and advertising revenue respectively, as well as their known bias towards government, the basis of them being selected to send journalists to Glasgow?”

“Were they selected by the diplomatic mission or was it based on government’s recommendation?”

“Were invitations extended to other news media organisations? If no, why not?”

CLIMATE of SECRECY
LOSS AND DAMAGE:

RELEASE
FIJI AIRWAYS ANNUAL REPORTS

The “Glasgow Climate Pact” was adopted despite a last-minute intervention by India to water down language on “phasing out” coal that don't use carbon-capture technology to merely “phasing down”.
Picture
Picture
“Loss and damage” is the phrase for the destruction already being wreaked by the climate crisis on lives, livelihoods and infrastructure. It had become a critical issue at COP 26, with the potential to make or break an ambitious deal in Glasgow. Vulnerable and poor countries, who claimed that they did little to cause the climate crisis, arrived with a determination to win a commitment from rich nations to compensate them for this damage. It had become perhaps the most bitterly fought-over issue of all, with the low-income nations believing they have a moral right to this money – some call it compensation or reparations. Rich parties such as the US and EU are very reluctant to comply, fearing exposure to unlimited financial liabilities. Fijileaks: Thankfully, with no accountability or transparency of FFP government finances, and the hiding of Fiji Airways and other annual reports, we should count our lucky stars that the rich nations didn't fall for Fiji's "LOSS AND DAMAGE" fishy kawakawa financial bait for more cash freebies at Glasgow COP26. They were RIGHT to COP OUT on Loss & Damage

BRITISH COP26 President ALOK SHARMA 'fought back tears' and said he was 'deeply sorry' for the change. What about KEROSENE, Khaiyum?
The use of kerosene lamps (and kerosene to burn DRAFT YASH GHAI CONSTITUTION) contributes to climate change in the same way as the burning of other fossil fuels does, by releasing CO2. The difference is that kerosene also emits a significant amount of black carbon,
a short-lived but potent greenhouse gas

"I was saying why are you setting it on fire? You have shredded it, nobody can put it together or you can just take it with you and you can cut a bit further, but they insisted on, they brought a TIN OF KEROSENE and spread all the papers, brought some stick (destruction of trees) with a flame at the end and started burning of it, and every few minutes or seconds they would come and put another DOSE OF KEROSENE, so the flames would rise up again until everything was reduced to ashes."
Professor YASH GHAI on the 'kerosening' of his Draft Constitution, that also resulted in damage to Fiji's already fragile climate

Picture
In the end game, which lasted for more than an hour in the plenary hall, China said it would like the language on reducing coal use to be closer to the text that it had agreed to in a joint statement with the U.S. earlier in the week. But it was left to India to spell out the last-minute change. Instead of agreeing to “phase-out” of coal power, India’s environment minister, Bhupender Yadav, read out a new version of the paragraph that used “phase-down” to describe what needs to happen to coal use. That formulation made it into the final text endorsed by almost 200 nations.

DIWALI SPOILER: Richard Naidu, 'On Thursday 4 November, the Diwali religious and public holiday, based on complaint from Saneem, a Police officer delivered to Sharvada Sharma a letter from Judicial Commission.'

Fijileaks: We may recall that it was during Diwali celebrations in 2016
that Mohammed Saneem, while visiting India, had got Fiji's High Commissioner to India, NAMITA KHATRI, fired from her job. He complained to Aiyaz Khaiyum about her, who complained to Frank Bainimarama. The then Foreign Secretary ROBIN NAIR asked Khatri to come back to Fiji after Christmas, giving her 3 months notice. We believe Yogesh Karan, permanent secretary in Prime Minister's Office got involved and told Khaiyum that Nair has given Khatri three months. Khaiyum demanded that she has to vacate the Fiji High Commission forthwith and leave New Delhi within 7 days. The poor woman had a
child and had to pack and leave on her own. Now, another Hindu, SHARVADA SHARMA, had his DIWALI ruined by the Supervisor of Elections MOHAMMED SANEEM. Sadly, if only lawyer
RICHARD NAIDU and the Fiji Law Society had mounted a legal challenge against Saneem's appointment (for he didn't have the requisite qualification to be appointed as Election Supervisor) we would not have had to deal with Khaiyum's 'House Elf' who is totally on the loose.
House Elf:
a magical being which was immensely devoted and loyal
to the one designated as his master - in this case to Aiyaz Khaiyum.

The man responsible for the parlous state of the judiciary and the breakdown of the rule of law and justice is SITIVENI RABUKA, the racist satan now leading the People's Alliance Party, and hiding behind the cloth of IMMUNITY. He tore up the 1970 Constitution, sacked and jailed judges and magistrates, all because he had the GUNS to enforce his Coups. And yet RICHARD NAIDU, we have been reliably informed, on behalf of Rabuka's Elf - BIMAN PRASAD - is holding secret meetings with Rabuka's political team, to form a loose coalition to fight the
2022 general election. A belated Happy Diwali, folks!

Rabuka’s 1987 terror regime: A Warning

“Every time we shrug when we hear of another midnight raid, the cries of terrorized women and children, then somewhere in Fiji another potential [Klaus] Barbie [The Nazi Butcher of Lyon in France] is getting a start in life,” said the former Methodist communications secretary in 1987, the Reverend Akuila Yabaki, now head of the Citizens Constitutional Forum. He was speaking out against the reign of terror and torture practised mostly against the Indo-Fijian community by Sitiveni Rabuka, his military henchmen, prominent chiefs, and the dreaded and racist Fijian taukei foot soldiers following the 1987 coups.
Dr Bavadra’s spokesman and current Suva lawyer Richard Naidu was arrested and detained on different occasions, he was chased and beaten up by Taukeists, and finally had his Fiji nationality revoked, and ordered to leave the country for New Zealand. Another legal adviser of Dr Bavadra, John Cameron, had his work permit withdrawn after he filed civil suit against dissolution of Parliament, and had also filed claim with the Supreme Court on behalf of a client harassed by the RFMF, seeking a declaration that State of Emergency and 1987 Emergency Regulations were unconstitutional. Among judges arrested included Justices Kishore Govind and Rooney, including Chief Magistrate Howard Morrison. Even the Police Commissioner, an Indo-Fijian Pramesh Raman, whose job M Rabuka had applied a week before the coup, was taken into custody. Several Indo-Fijian lawyers and academics were also taken into custody, mostly on legal advice of some Fijian lawyers."
