We send you our warm greetings from the Secretariat Office at 66 McGregor Road in Suva.

We trust that you have all enjoyed the blessings of Christmas and the special time you have spent with your family members and friends.

We are just two days away from the New Year and whilst we do not want to dampen your preparations for the New Year, we thought it proper to advise you all of the recent decisions of the Supervisor of Elections, Mr. Mohammed Saneem.

Some of you would have heard the Fiji News yesterday that the Peoples Democratic Party was suspended from yesterday afternoon. That is correct. The reason for their suspension is purportedly for not registering with the Elections Office the name of their Registered Officer after Lynda Tabuya's resignation which was received at the Elections Office on 21st December, 2017.

REQUIREMENT TO SIGHT THE MOU THAT WAS SIGNED ON 9/12/17

Apart from the above the SOE also wishes to sight a certificate of the Memorandum of Understanding that was signed between SODELPA and PDP on 9th December, 2017.


It appears that the SOE is amongst others who have misunderstood  the issue surrounding the PDP's decision:
 
1.  not to contest the GE of 2018 as a Party, but 
2. to allow its members to join any other Political Party for purpose of contesting the GE and 
3. the MOU that was signed between SODELPA and PDP.
 
Aman Singh resigned from PDP and joined Labour Party, Lynda and Vijay Singh resigned from PDP to join SODELPA.
 
The two individuals, Lynda Tabuya and Vijay Singh had formally advised the party that they had resigned from PDP during their Management Board meeting on the 7th of December, 2017. 
 
Reading through the SOE's Press Statement, he appears to think that the MOU is a merger between SODELPA and PDP. According to the Political Parties Decree, 2013, section 13(4), the signed merger agreement should be made available to the Registrar of Political Parties within 21 days of the signing of the agreement.  
 
The MOU that was signed between SODELPA and PDP is not a "merger" as defined under section 2 (Interpretation) of the Political Parties Decree, 2013, which states and I quote below:

"Merger means where 2 or more political parties consolidate their operations and combine all officers, structure and other functions of the political parties".
 
The signed MOU clearly states that " it shall not be construed to create a relationship between the Parties of agency, legal partnership, joint venture or any other similar arrangement or to render either Party liable for any debts or obligations incurred by the other."
 
Our Party Constitution stipulates at section 23.0 that "the Party may establish working relationships with other Parties for mutual benefits."
 
The MOU is premised exactly on section 23.0 of the Party Constitution, i.e that "the MOU is based on the spirit of unity, cooperation, reciprocity, and of mutual benefit to both parties.
 
THE REQUIRED DOCUMENTS FROM SODELPA REQUESTED BY THE SOE

At about 4.00pm on Thursday 28th December, a letter was delivered from the Supervisor Of Elections to the Party Registered Officer and the letter requested:
 
1. certified copies of the MOU that was signed between SODELPA and PDP on 9th December, 2017, as he wishes to determine whether the MOU was  a merger between the two parties, and if so, it warrants the registration of a new party altogether, and
 
2. the minutes of the 9th December, SGA, wherein Mr. Vijay Singh was elected as one of three Vice Presidents of the Party.
 
 We have also received questions from the Fiji Sun and the Fiji Times on the news item and our response is pasted at the end of this email.


Please be assured that the Party remains firm in its resolve to contest the General Election of 2018. 

SODELPA has nothing to hide, this was no sinister move to circumvent the rules set out in the Political Parties Registration etc Decree of 2013, and the party is looking at the request from the Supervisor of Elections who is Registrar for Political Parties under the 2013 Decree, with a view to complying with the information requested by Mr. Saneem.

We shall keep you informed of the progress on these matters.

In the meanwhile, we would again like to take the opportunity to thank you all, our local and overseas supporters for your continuing support for the Party. We thank you for your sacrifice and commitment to the Party. Let us continue to hold hands and together move forward to fight the General Election and be victorious.

Tabuya says they needed to rethink their strategies moving forward. She says pre‑elections coalitions is just not legally possible in the current election system. 1) Have you two resigned from the PDP?
2) If so, when did you resign?

Who accepted your resignations?
4) Who is temporarily in charge of PDP?

6) Tabuya, when did you apply to be CANDIDATE? When were you (if at all) interviewed by the SODELPA SELECTION COMMITTEE? Right up to 8 December, and a day before the announcement of candidates, you were insisting that you were not a member of SODELPA. You claimed you were still leader of PDP in talks with SODELPA. But on 9 December Rabuka claimed you had resigned from PDP and have joined SODELPA, with Singh appointed as a VP for SODELPA?
7) Why should there be a Memorandum of Understanding (MOU) if you two have resigned from PDP and joined SODELPA.
A MOU is a document that expresses mutual accord on an issue between two or more parties. MOUs are generally recognized as binding, even if no legal claim could be based on the rights

On what grounds did the PDP Management Board, to use your own statements, grant you authority to sign a MOU with Sitiveni Rabuka? Come off, its like a Board of Trustees granting former Directors the powers to sign off multi-million dollar deals? Who are you two fooling? Or are you two surrounded by FOOLS in PDP and SODELPA?
9) If you two have resigned and joined SODELPA, why the hell should you two be exempt from the rules and regulations of SODELPA Party Constitution?
8) Vijay Singh, you have become a VICE-PRESIDENT of SODELPA, so what is this garbage MOU that you have signed with Rabuka, allegedly at the behest of the PDP Management Board? Have you merged PDP into SODELPA?
10) Have you two informed of your departure to the Supervisor of Elections?
We call on the Election Supervisor to look into the whole shenanigan?
PDP slogan was: REAL CHANGE. Now, you have changed political sides, you have no bloody right, power, or privilege to be signing an MOU with Rabuka.

The people are not “gullible” and see right through this shameless self-promotional marketing, using a similar approach of a former radio announcer of that same station who now sits in Parliament. Ashwin Raj, on the other hand continues to over-extend himself both as the Director of Human Rights and Chair of the Media Industry Development Authority (MIDA). Obviously he confuses himself on which hat he wears on any given day because if he was thinking rationally, instead of using publicly funded air-time to “campaign” on hate speech on social media, he should have exemplified balance and advocated for a wider spread of opinions with more studio guests as per Schedule 1 Media Code of Ethics and Practice, of his OWN enabling MIDA Decree. Even as the Human Rights Director he of all people should be the first to promote balanced dialogue, instead of hogging the airwaves to promote a skewed worldview on "deliberative democracy"."

Media Release: Human Rights Director and MIDA Chair reeks of political puppetry
~ MIDA Chair breaches his own Law


National Federation Party Leader Professor Biman Prasad has today hit out at the appalling display of political puppetry by the so-called Director of Human Rights, Ashwin Raj, ably aided and abetted by the FBC ‘Speak Your Mind’ host, Shammi Lal Lochan on their segment which was broadcast on radio on Tuesday, 19 December 2017. https://www.youtube.com/watch?v=aqui15-4SC0 (Speak your Mind Link)

“The ludicrous situation where a public servant clearly colludes with host of a show of the State broadcaster, FBC — the head of whom is Riyaz Sayed-Khaiyum, the younger brother to the Attorney General who is already reeling under public disquiet on his handling of the ATS employee-owner crisis — to make political statements is so laughable its almost not worth responding to, but we are obligated to respond because taxpayers are not “gullible” as Shammi Lochan suggests, and need to hear a counter view.

The theme of the show was supposed to discuss “hate speech on social media”. As the Director of Human Rights, we expected more maturity and leadership in his responses. The listeners and viewers of the show will not need much convincing whether this is what they witnessed or not.

Ms Lochan’s maladroit attempt to take pot-shots at the NFP and reframe our public statement of 02 April 2017 is politically motivated twaddle with the objective of inferring that NFP is racially segmented or promotes xenophobia. This is grossly defamatory and we will be seeking legal advice on this.

If Shammi is an intending candidate of Fiji First party she should do the honourable thing and resign instead of using the publicly funded airwaves to raise her profile. Ashwin Raj, on the other hand continues to over-extend himself both as the Director of Human Rights and Chair of the Media Industry Development Authority (MIDA). Obviously he confuses himself on which hat he wears on any given day because if he was thinking rationally, instead of using publicly funded air-time to “campaign” on hate speech on social media, he should have exemplified balance and advocated for a wider spread of opinions with more studio guests as per Schedule 1 Media Code of Ethics and Practice, of his OWN enabling MIDA Decree.

Even as the Human Rights Director he of all people should be the first to promote balanced dialogue, instead of hogging the airwaves to promote a skewed worldview on "deliberative democracy".

If Raj was so concerned about international law and Fiji’s compliance on human rights international law, he should firstly restrict himself to what he can immediately control, and what he is getting paid for, and ensure compliance with the Paris Principles instead of shamelessly kowtowing to the government and speaking with glossy eyes fawning over them.

The State broadcaster FBC, the Human Rights Commission and MIDA all have not tabled Annual Reports in Parliament and are supercilious by not humbling themselves and show accountability to taxpayers funding their operations. This is the height of arrogance that is prevalent from this Government down to their stooges like those we see campaigning for them on public funds.

The Chair of the Fiji Human Rights and Anti-Discrimination Commission must remove Ashwin Raj immediately. Furthermore, the Prime Minister should remove him as the MIDA Chair.

He has failed to uphold his independence or at least try to show it in the public domain and serious questions arise as to his competence for both roles and his self-aggrandised continuous use of 4 syllabled words is an indictment of his inability to communicate effectively.

Ashwin Raj, by advocating for laws to curb hate speech on social media is a thinly veiled attempt to muzzle the negative publicity of this Government, and he should be speaking to Parliament with facts and figures, instead of hogging the airwaves to promote an unsolicited and tyrannical "campaign" with no public mandate.

Section 15 outlines the resignation process of persons before they join other political parties or take up executive positions in other parties. SODELPA leader Sitiveni Rabuka, general secretary Adi Litia Qionibaravi and party president Ratu Naiqama Lalabalavu breached Section 15 when they welcomed Tabuya and Singh into SODELPA at the Special General Meeting on 9 December. Rabuka, Naiqama and Qionibaravi could also be cited under Section 19 of the Decree, in assisting in the commissioning of a breach of the decree which can lead to de-registration of a political party. It beggars belief that neither the motormouth SODELPA MP Niko Nawaikula nor lawyer Qionibaravi read the Political Parties Decree to Rabuka before his reckless and illegal decision. We wonder if Rabuka had deliberately infiltrated SODELPA to help close it down for the political benefit of FFP? We checked with the Fiji Elections Office and Tabuya and Singh were still with PDP while at the same time they were politically sleeping in bed with Rabuka. So SODELPA has breached S15

He walked away with $800,00 a year salary and FICAC is yet to take him into custody for alleged fraud at the Fiji Sugar Corporation

"It was only a matter of time before others unmasked their coup faces. One of them was Riyaz Sayed Khaiyum, the brother of Aiyaz. Long before his name was announced as the new CEO of the Fiji Broadcasting Commission, a journalist colleague of his on TVNZ’s Down Under had tipped me off that Riyaz was planning to return to Fiji for “top FBC job – nepotism bro!”, with me quipping, “I liked his style on Fiji TV Close Up”. His NZ journo colleague retorted: “He will sacrifice all to become mouthpiece of the illegal lot, bro – his brother is getting him the FBC job”. He was stating the bleeding obvious that in the near future Riyaz would become his “brother’s news keeper”."

The FBC’s official website had jumped the gun and had announced Riyaz’s appointment before the Board made a formal announcement. An unhappy David Whippy told the media: “The problem is that the Prime Minister's office has changed the conditions and we were not told about the announcement. We need to tell the applicant about this significant development as he may not accept the conditions in its present form." Whippy said the package was slightly lower than the one which former chief executive Francis Herman received before he resigned in June of that year.
He said it was a bad idea that government companies competing in the commercial market were aligned to a permanent secretary as emoluments that attract the right candidate who could achieve the company's objectives needed to fill in the vacancy. Riyaz and and former radio executive and media sales manager Esava Cakau had been shortlisted for the CEO position.
Regime lackey Parmesh Chand covers appointment
Parmesh Chand said Riyaz was recommended by the Board and endorsed by Bainimarama. “The advertising, short-listing, interviews and recommendation of appointment of a suitable candidate are all made by the board (FBCL). They are, with the support of the Public Enterprise Minister, submitted to the Prime Minister for endorsement,” Chand said. He said matters such as a conflict of interest were non issues as far as the office of the interim Prime Minister was concerned. Basically, the law of the dictator ruled supreme in post-coup Fiji.
The big brother Aiyaz passed any questions to the FBC Board saying the appointment of any person in a government statutory body was done by the appropriate authority. “As such, queries regarding the procedures followed in the appointments should be directed to the appropriate authority. In this case, questions regarding the appointment of Riyaz Sayed-Khaiyum should be addressed to the board of FBCL.”

One wonders if all talk about Government giving free education is just a smokescreen or was the grant stopped at the whim and fancy of Reddy as Education Minister? Khalsa wants MOE to pay up outstanding money. If not, the Management has threatened to close the schools! Its not 'Water Under the Bridge' despite Reddy becoming the newly created Minister for Waterways and Sewage Plants

In a series of e-mail exchanges between Iowane Ponipate Tiko, Permanent Secretary for Education, Heritage & Arts, and the Management of the Khalsa College and Khalsa Primary it is revealed that the MOE has an outstanding amount of $462,8976.17 for both of the schools - Khalsa College and Khalsa Primary in Labasa. The grant was stopped by the then Education Minister Mahendra Reddy.
 
In one of the e-mails cited by Fijileaks and dated 27 October 2017, the Management rejects Tiko's claim that Free Education Grant (FEG) is to be used as per 6 stipulated allocations. The Management of Khalsa schools insist that rental of properties should also have been allocated and inserted within one of the allocations.

"It’s unfair that our Committee is being deprived of not being paid for usage of buildings as the buildings rightfully belong to the Labasa Sikh Temple Committee," the Management wrote to Tiko.
 
According to the School Management's records the  MOE has an outstanding, unpaid FEG, amounting for both their schools as follows below:

SGN Khalsa College         2016                    $159,143.17
SGN Khalsa College         2017                    $116,874.84
SGN Khalsa Primary        2017                     $47,611.84                                                                   ------------------                                                             TOTAL: $462,896.17
On 10 September 2017 Tiko had written to the Schools Management as follows: 'Good evening; 
Unfortunately the usage of FEG cannot be utilized through your so called leases/Rentals of the schools. The stipulated usage of FEG is supposed to be in accordance with the six allocations mentioned within the School Financial Management Handbooks 2013 of the Ministry of Education.

 
The Hon Minister for Education and Prime Minister has issued a directive that all misused FEG money ought to be recovered through agreed instalments and these issues about school lease would need to be handled by the school management in some other ways but not from the Free Education Grant of government.  This is where we will take to court all offenders who abuse the Free Education Grant for schools.  For now we will centralize all FEG for both schools until all repayments of lease are repaid to the MOE.
 
I hope a clear understanding on the issue will be reflected from the school management and other stakeholders.  All other schools that have abused the usage of FEG, by doing what is not mentioned or mandated in the six allocations of the School Financial Management handbook of MOE have been requested to reimburse the amount taken in some monthly instalments as their FEGs will be centralize at the Education offices.
 
I am just reiterating Mr. Singh the stand of our current Minister for Education.

GOVERNMENT Telecentre: Prime Minister Bainimarama opened the third out of the five telecentres in Vanua Levu at Shri Guru Nanak Khalsa College on 10 September 2013. This Telecentre is for the use of students during school hours and the rest of the community in the evening and on weekends. Bainimarama and Aiyaz Sayed-Khaiyum also took the opportunity to distribute copies of the 2013 Constitution and hold a Talanoa Session with the community members there.

A Police complaint has been lodged against a SODELPA candidate for the 2018 General Election, Ezekiel Sharma on allegations of inciting communal antagonism. Director of Human Rights and Anti-Discrimination Commission Ashwin Raj has lodged the complaint with Fiji Police Force’s Criminal Investigations Department. In his complaint, Mr Raj is alleging that Mr Sharma’s comments on a post on social media was inciting communal antagonism. Questions have been sent to Mr Sharma and also to the General Secretary of SODELPA Adi Litia Qionibaravi on the matter. When contacted yesterday, Adi Litia acknowledged receiving the email and confirmed that she will respond. At around 8pm, Adi Litia responded: “I am not aware of this complaint and cannot make a comment. Is there a statement from the Director FHRADC or the Police that you are reporting on? Please share the statement to me.” No further response was received either from her or Mr Sharma.

In his complaint, Mr Raj said: “I request that this matter be urgently investigated given its potential to promote feelings of ill will between religious groups and ethnic communities in Fiji. The matter warrants urgent attention for two reasons.“ First, these comments must be read in the context of a surge in hate speeches in the social media based on religion and race, which are both prohibited grounds of discrimination given Fiji’s history and our prevailing political context given that Fiji is on the cusp of a General Election.

“Second, consideration must also be given to the status of Ezekiel Sharma and his ability to influence the public in his capacity not only as a candidate for General Election next year under SODELPA, but also in his capacity as a religious leader.”

US ambassador to Fiji, Steven McGaan's secret cable to Washington from Suva, re Parmesh Chand's views on Khaiyum's influence on Bainimarama (Wikileaks)

"Fiji’s highest ranking civil servant, Parmesh Chand,  reached out to the Ambassador to express concern, both his own and on behalf of others within the IG [Interim Government] seeking elections in 2009, about the AG’s influence with Bainimarama.  Chand’s view, that the AG has captured the ear of Bainimarama in a negative way, is widely held in Fiji.”

Fijileaks: Let us nor run away from one crucial fact: The deposed Prime Minister Laisenia Qarase secretly fled Suva for his island on Mavana, leaving his supporters to Bainimarama's military after the 2006 coup. Unlike previous coups of 1987 and 2000, a vast majority of native Fijians simply melted away, only to re-emerge as Facebook warriors on Fiji. We are surprised that Parmesh Chand is willing to stand as a SODELPA candidate under the leadership of SITIVENI RABUKA who not only started the coup culture but raped, assaulted, tortured, and disenfranchised Indo-Fijians. He also beat up and disenfranchised moderate urban native Fijians and Others in his racist and unconstitutional 1990 Constitution. And yet many of Rabuka's supporters have 'rabbit hole mentality'. Strangely, they are not objecting to the inclusion of Peceli Rinakama's name on the SODELPA candidates list. He was not only a co-conspirator with George Speight in overthrowing the Chaudhry government but the MPs were held hostages for 56 days. The SVT MPs had been released within minutes of the takeover of Fiji's Parliament. We might never have heard of Bainimarama and Khaiyum if Rabuka had not started the coup culture in 1987. He is now back, leading SODELPA into the 2018 general election. Cry the Beloved Country!

GOD HAVE MERCY ON PRISONERS WHO HAVE GONE BEYOND THEIR REQUISITE SENTENCES IN FIJI PRISONS. The Prerogative of Mercy Commission is non-existent because President yet to get member list

The 2013 Constitution of Fiji, unlike the 1997 Constitution, has taken the prerogative of mercy power away from the President and it looks like gave it to the Attorney-General Aiyaz Sayed Khaiyum. Khaiyum is the Chair of the Prerogative of Mercy Commission. In May 2015 he told Parliament that Members of the Commission will be appointed soon and all applications will be assessed by the Commission. Its nearly Christmas 2017 and many prisoners have the right to petition for mercy but the list of names for the Mercy Commission have not been forwarded to the President. In his Parliament response, Khaiyum had informed us that the Judicial Service Commission was in the process of appointing the four-member commission with him the chairman [Raja]. "Once they have done that, any applications made under the Prerogative of Mercy Commission will then be assessed by the commission." He also admitted that there was no Parole Board. He was responding to questions regarding whether 2000 COUP conspirators, Timoci Silatolu and Josefa Nata, had applied for parole. The two have already served minimum sentences of nine and seven years respectively of their life imprisonment sentence for TREASON but are still behind bars. "...I certainly can speak on Mr Timoci Silatolu and Josefa Nata, they have not applied for parole; in fact there's no parole board at the moment."  It was pointed out to him in Parliament that Silatolu and Nata's fixed terms of nine years and seven years had expired in 2012 and 2010 respectively but they were still being held in prison. To this Khaiyum said the sentences were mandatory, and it did not mean that after serving those terms they could automatically be released but rather it was a minimum period required for their life sentence. He said if need be, there was a particular process in place where, in the absence of a parole board, cases could be brought before the Prerogative of Mercy Commission. He said the Judicial Service Commission was in the process of appointing the four-member commission with him as the chairman. "Once they have done that, any applications made under the Prerogative of Mercy Commission will then be assessed by the commission." The 1987 and 2006 coupsters, led by Sitiveni Rabuka and Frank Bainimarama, are shielded by Rabuka's IMMUNITY contained in the 1990, 1997, and 2013 Constitution

IT'S CHRISTMAS TIME and many prisoners in Fiji have the right to petition for mercy. It is usually a prerogative power of the Monarch/President but the 2013 Constitution of Fiji, unlike the 1997 Constitution, has taken that prerogative away from the President and it looks like gave it to the Attorney-General Aiyaz Sayed Khaiyum. That is wrong and against all principles of mercy and natural justice.

The members of the Judicial Services Commission (JSC) are the Chief Justice Anthony Gates, Solicitor-General Sharvada Sharma, the president of the Fiji Court of Appeal Justice William Calanchini, and Jane Ricketts. There is no Mercy Commission as the JSC (which provides the names to the President after consultation with Khaiyum) is not able to put forward the four names.

Judicial sources claim that Khaiyum is not consulting with the JSC. But why is the JSC inactive on the matter? Why can't it approach Khaiyum directly on the membership and supply the names to the President?

Meanwhile, with Christmas fast approaching, relatives of the prisoners affected are very disappointed that their loved ones are stuck in a limbo because of the membership issue. They are praying for a speedy resolution, and even looking up to 'GOD TO HAVE MERCY' on the plight of the prisoners who have gone beyond their requisite sentences in Fijian prisons.

Sadly - many of these prisoners children are also waiting for a gift from 'Father Christmas' - a reunion with their fathers and mothers still behind bars.

Fijileaks: This "Masi Polo" native Fijian JUDAS Tiko (above) had threatened to cut off financial contribution to Fijian Teachers Association if Leawere and others did not publicly show support to bullying Education Minister Reddy; we had not disclosed this information after pleadings from  FTA; in fact, Reddy had personally phoned and threatened to stop the funding if Fijileaks continued to reveal the rotten state of affairs at Education Ministry; Tiko to Leawere, 15 January 2015: 'In stating the above Sir, The MOE is awaiting the FTA executives to practice a little show of respect and present at least a little 'matanigasau' to the MOE and its Hon. Minister after the serious of negative comments and unprofessional attacks voiced in the media and blog sites.'
