​*We won't be surprised if the unelected and slimy Leung will claim that Fotofili was not appointed as a substantive holder of the post, that is to say he was not appointed as Deputy Commissioner but only to "act" for three years - a cunning and deceptive response, thinking Fijians of all races are mentally retarded or kai colos who can't see through Leung.
*When did Fotofili RESIGN as Resident Magistrate at Nasinu, for five days before his appointment, he was sentencing an accused on 14 February 2025.

  1. PARAM VIR MAHARAJ you are found guilty and convicted in respect of each of the offence in the three counts mentioned [the two counts of obtaining property by deception and one count of using a prohibited title].
  2. You will receive an aggregate or combined sentence for three offences.
  3. You are sentenced to an aggregate 27 months imprisonment equivalent to 2 years and 3 months imprisonment [this is your head sentence].
  4. Minus the 7 months for your time in remand, your aggregate sentence is now reduced to 1 year and 8 months imprisonment.
  5. I cannot suspend your aggregate sentence either in part or in whole as your head sentence is more than 2 years imprisonment.
  6. Since your head sentence is more than 2 years imprisonment, it is also mandatory by law that I must impose a non-parole period on you.
  7. The nature of the offence requires that you serve some time in prison, there is no question about that.
  8. There have been developments since you committed this offence in 2015. The years this case has been pending against you and you complying with your bail conditions consistently can itself be a form of punishment. Your health too has deteriorated.
  9. Your lack of remorse is painfully clear though.
  10. I am of the view that a minimal but meaningful non-parole period will meet the objectives of your sentence especially as you have spent time in prison already in remand.
  11. From your remaining aggregate 1 year and 8 months imprisonment, I order that you serve 1 month imprisonment before you are eligible for parole.
  12. As part of your punishment, I also order the forfeiture of the entirety of your cash bail of $2,000 which is currently in the court’s possession and this cash bail will be paid into court as your aggregate fine for the three offences and this ordered pursuant to section 15 (1) (a) and (f) of the SPA.
  13. Pursuant to section 49 (1) (a) of the SPA, I also order the release of the $730 and $800 [total of $1,530] which you paid into court as compensation, these monies are to be released or to be paid to Ms. Takayawa and Ms. Begum respectively as soon as practicable.
  14. The prosecution is to advise the victims to see the court registry as soon as practicable to make the necessary arrangement for the release of these monies to them.
  15. PARAM VIR MAHARAJ, I now discharge you of your bail obligations.
  16. You will start serving your imprisonment term immediately and a committal warrant will be issued accordingly.

Fijileaks: The RFMF and Fiji Police must take the NFP leader Prasad into protective custody before the FICAC charges are 'sabotaged' and he resigns as Finance Minister and flees to AUSTRALIA or to INDIA.
*He was going to be charged on 5 September for multiple counts of providing false declaration of assets, income and liabilities from 2014 to 2024 (as exposed by Fijileaks) contrary to Section 24 of the Political Parties, Registration, Conduct, Funding and Disclosures Act 2013.
*We have reported him to Fiji Police (with documents) that he allegedly also committed criminal offences as co-Director of Lotus Construction (Fiji) Ltd, including tax offences.
*We repeat, he must RESIGN and FICAC must be allowed to charge him.
*Fiji must be laughing at him. He had been reading to Savenaca Narube  the Fiji Public Order Act, accusing Narube of 'sabotaging' the economy.

Unknown to many, Fiji’s Public Order Act allows for sanctions of imprisonment of up to ten years for spreading any report or making any statement which is likely to undermine or sabotage or attempt to undermine or sabotage the economy or financial integrity of Fiji.

In simple terms, economic sabotage by a politician refers to actions taken by a public official that intentionally undermine or harm a country’s economy for personal gain, political advantage, or ideological reasons.

It’s not a formal legal term in most places, but rather a concept used to describe destructive behaviour that prioritises self-interest or agendas over the public good.

Last week comments made by Unity Fiji leader Savenaca Narube at the Climate Integrity Conference 2025, in Canberra, Australia were described as economic sabotage by the Deputy Prime Minister and Minister for Finance, Prof Biman Prasad.

Mr Narube had called for “a review of the modality of Australia’s general budget support” to Fiji. He had questioned why was there a large delegation to COP29 in Baku.

“The question that I silently asked was this: Why would donors such as Australia agree to fund such excessive delegations? Is it a reward for good family behaviour,” Mr Narube said.

He also pointed out why there was an increase in Cabinet size from 26 to 35.

“This cost is additional to the huge increase in salaries and tax-free allowances that the Parliament awarded themselves within six months of forming a new government. A Parliament deciding how much to pay themselves is unethical and may be illegal.”

Mr Narube had said this self-serving prioritisation was irresponsible.

“I would therefore like to see a review of the modality of Australia’s general budget support.”

He added while the recipients should continue to enjoy flexibility on how they spend the general budget support, “the policy triggers must be tightened to ensure that donors’ funds are effectively used”.

Prof Biman Prasad didn’t take this lightly and launched a vicious attack on Mr Narube, stating the Unity Fiji leader’s suggestion that Australia should review its modality budget support to Fiji is clearly “an attempt to sabotage our economy”.

He said Mr Narube’s claims that the Coalition Government was misusing funds it received from Australia was baseless and an outrageous lie.

“Narube, who has failed miserably in two national elections to get elected into Parliament, has reached a new low. To suggest that Australia should review its modality of budget support to Fiji while lying about how this budget support is being misused by the Coalition Government, more than anything, reveals his true character and his unworthiness to lead Fiji”, Professor Prasad said.

The Minister for Finance said it was public knowledge and “absolutely clear” that the size of the Fiji delegation to COP 29 in Baku was 56 and not 100.

He said 91 per cent of the total cost of $1.2 million was funded and the Government only forked out the cost for five delegates. They were for the Leader of the Opposition, two Opposition parliamentarians, and two delegates from the Ministry of Multi-ethnic Affairs and Sugar Industry.

He added Government only forked $238, 739 while $960,065 was externally funded.

“And external funding did not come from Australia alone,” said Prof Prasad.

“Of course, Narube would not know this because he has never been to a climate change COP, but has overnight become a climate expert because he is a mouthpiece for someone who was disappointed that the Coalition Government did not use his “expertise,” said Prof Prasad.

“Narube was certainly around in November 2017 when the former Government took almost 80 delegates to COP23. He was certainly around in May 2019 when the then Leader of the Opposition and now Prime Minister (Sitiveni) Rabuka revealed in Parliament how procurement procedures were waived to award Qorvis over $4 million in contract to manage public relations and communications about Fiji’s participation in COP23.”
Prof Prasad further said Mr Narube “never opened his mouth”.

“And now he is not only insulting Fiji and trying to sabotage our economy but also ridiculing the intelligence of the Australian Government, which has provided and continues to assist in the rehabilitation of our public health sector and construction of new schools to ease overcrowding of classrooms in our current schools.

“This is a gross insult to Australia and their taxpayers who deserve basic decency and not to be lectured by visitors about how to conduct their funding, particularly at events hosted in Canberra.”

The Deputy Prime Minister added Fiji is grateful to Australia for being its largest development partner.

“Australia and other donor partners do not give budget support to Fiji like a blank cheque. As a former bureaucrat in the Ministry of Finance, Narube should know that these agreements have strict conditions and evaluation processes”.

“It is quite shocking that as a consultant and former RBF Governor, Narube deliberately ignores how basic accountabilities and reporting are built into all budget support arrangements.

“If Narube thinks squealing overseas, making statements that are unpatriotic and an attempt to sabotage Fiji’s economy is boosting his political fortunes, he is daydreaming.”

*There is a Tender Committee at FICAC that looks at procuring any goods or services for more than $50,000.
​*In fact, for anything above $100, you need three quotations.
*And in the Malimali-Waqanika case, it was more than that amount Waqanika had been paid, which is in breach of the Tender Procedure.
*The Process is that quotations will be sought and the Tender Committee
will deliberate and submit a paper to the Ficac Commissioner with its recommendations on the successful applicant.
*The two so-called lawyers - Barbara Malimali and Tanya Waqanika - could have easily confirmed the process from Ficac's Finance Manager.
*We understand that the FM advised them but Malimali railroaded the Finance Manager into paying Waqanika, threatening DISMISSAL.
*However, Malimali nor Waqanika were entitled to the thousands of dollars of taxpayers money because the COI is looking into Malimali's appointment by the JSC (CJ Salesi Temo and A-G Graham Leung) as FICAC Commissioner.
*The COI is about her appointment which she is attending in her personal capacity. FICAC is not a party to the COI.

The Commission of Inquiry has once again emailed Prime Minister Sitiveni Rabuka and President Ratu Naiqama Lalabalavu regarding the recent actions of Fiji Independent Commission Against Corruption Commissioner Barbara Malimali.

Senior Barrister Janet Mason revealed that Malimali had emailed the inquiry yesterday, questioning how terminated Manager of Investigations Kuliniasi Saumi had access to documents.

Mason stated that they were unhappy with Malimali’s actions and had written to Rabuka and Ratu Naiqama earlier today, outlining their grievances and discussing legal options, though details were not disclosed to the media.

She confirmed that Saumi returned to testify today, presenting relevant evidence before the inquiry.

“And this then highlights why her, going on leave was just not sufficient. If she had been suspended she could not have done that, but she got back to us yesterday complaining about Mr Saumi having access to the documents.”

During the proceedings, Malimali terminated Saumi, a key witness. Following his termination, the COI has been calling for Malimali’s suspension. Although she has taken leave, the COI believes she should have been suspended instead. Source: FBC News

Act 2014.
4. I note that Biman Prasad did not declare that his wife one Dr Rajni Chand is the trustee of the Global Girmit Institute and that it facilitated the funds of $200,000 given by the Coalition Government. The Not for Profit Organisation was re-registered in 2023, after it deregistered in February 2022 for failing to supply its financial statements as required under the laws of Fiji.

The period of re-registration falls within the required period upon which 
Biman Prasad is required to declare in his 2023 Financial Declaration (Attached is exhibit 3- Global Institute Deed of Trust and Registration Documents).

5. I note that Biman Prasad did not declare his connection to Ganesh Chand and Hirdesh Sharma whom are the registered Trustees of the Global Girmit Institute upon whom received $200,000 of Tax payers funds. This is a breach under section 24

(a) (b) (iii) of the Political Parties Act. I submit that no tender was called in relation to the event organisation.

​You must, therefore, refer the matter to FICAC under section 18 of the Political Parties Act.
