Aiyaz Khaiyum to Karavaki: "The general election is the only thing that determines whether a Government lasts and not by any other means"; No, missing By-Election Provision would have determined longevity!

* By-elections are a gauge by which the popularity of the incumbent government is measured;
* By-elections can make real difference to balance of power when a ruling party's majority is lost in by-elections through deaths, resignation etc etc!
* Now, in Fiji, we have an electoral system where losers from all parties are waiting to be inducted into Parliament under Father Arms/Khaiyum's d'Hondt system, with Khaiyum enjoying unfettered power for next 4 years

Sayed-Khaiyum responds to Karavaki warning

ATTORNEY-General Aiyaz Sayed-Khaiyum said the general election was the only thing that determined whether a Government lasts and not by any other means.


He made the comment in Parliament during his right of reply to comments made by Opposition Member of Parliament Semesa Karavaki who said the end of the Government was near. Mr Karavaki did not withdraw his statement when asked by the Speaker, Dr Jiko Luveni whether he wanted to do so.

Mr Karavaki while contributing to the Sugar Industry Amendment Bill 2015 said the commissions had been removed with appointing authorities now vested on the Minister for Sugar.

Comparing with biblical stories, Mr Karavaki said even God instructed his people to make appointment through His criteria.

He added if that wasn't followed in Fiji, his fear was that this Government was bringing a structure to exert control over all avenues.

"They are taking over God's position and my fear is that this country is going to the brim of collapse," Mr Karavaki said.

He added if Government does not relook at the way it's going, then the end of this Government was near; this he said, was not associated to any current happening in the country.

"I say this with great conviction, I know my message is totally different; I have been convicted to give this message because if this Government does not relook at the way it's going, then, I am also convicted that the end of this Government is near.

"The end of this Government is near, I am not speaking on any other things happening, it is the conviction that I am given to say this because if we see here, even the appointments, the power if only granted to the minister to appoint certain people which are specified here," he added.

Government MP Samuela Vunivalu raised a point of order saying that it was seditious to say that the end of Government was near where Speaker Dr Jiko Luveni asked Mr Karavaki if he wanted to withdraw that statement.

He later asked the Speaker of what he said that was seditious. Source: Fiji Times

Both this very bizarre electoral system – which no one understands- and this very, very FRAUD 2013 Constitution are being forcefully shoved down the PEOPLES’ throats.

Now that is what the PEOPLE of Fiji think is Seditious.

Did the Qarase government come to power through a general election? Why was its term in office terminated by " other means " by Khaiyum, Bainimarama and their co- thugs ?

Karavaki is a pastor of the Seventh Day Adventist Church. They believe in the Apocalypse as outlined in the Book of Revelations when God (Jehovah) in all His Glory will descend from the heavens to pass judgement on everyone on earth. For them the Apocalypse is approaching and all are advised to repent now before it is too late.

For Karavaki and his ilk, Frank and his government must repent and commit everything to God for the end is nigh.

KARAVAKI brought disrepute to 2006 Elections Outcome by breaching the 1997 Constitution left right and centre:

1. Elections Office under his leadership DID NOT order a deferral to Elections but accepted an early election date so to not have sensors completed as was required under the constitution.

Your office should have recommended to the President election be deferred and an Interim Government be installed in the event the existing government had NOT followed the Constitution by not bringing about the required Censors prior to the election.

2. Since elections had been ordered to take place anyway, Karavaki FAILED to re-draw Provincial Communal Boundaries as was required under the 1997 Constitution so to provide EQUAL SUFFRAGE to each I-Taukei vote as was directed to be done by the 1997 Constitution for the subsequent elections after first elections held under the 1997 Constitution.

This could have easily been done by going through registered voters and addresses, BUT KARAVAKI breached the Constitution.

3. Karavaki's Elections office breached provisions of participation in Lower House Election process. Just like President had maximum of 2 terms for the office, Parliament's Lower House also had maximum of "2 elections" participation in elections. Anyone who had taken part in 2 elections even if they lost both times, they cannot take part 3rd time.

But under KARAVAKI'S leadership, the representatives of Opposition, Government in Electoral Office collaborated and ignored this provision BUT Karavaki could only approve candidates under the Constitution requirements meaning most politicians who took part in 1999 and 2001 elections had NOT qualified to even be nominated as candidate in 2006 Election.

The GCC had added this provision in the 1997 Constitution after the Reeves Commission handed over the review report for their approval. GCC added this to ensure there is no more greedy politicians to influence military to disturb peace in future for their own return to parliament under dubious means and fooling the poor Fijians.

No political party opposed because they all breached it together. They all are tainted hence they supported Ghai Review so to hide their own crime.

I THOUGHT WE HAD CONSTITUTION EXPERTS IN FIJI...who had not said a word on these matters.

So past constitution breaches led to new creations by Aiyaz hence can't say where the blame lies.

Just as we moved on from those breaches without any party appealing, now same way the 2013 constitution has been entrenched by the same peoples participation so they are back in parliament.

CAN OPPOSITION MP's raise these matters in parliament also?

What a liar and hypocrite! If that is so; how did he come into power in the first place? Wasn't he part of the mob that ended the reign of an elected government not by election but by a coup.

This just confirms how mediocre a lawyer Khaiyum is. Someone trained as a lawyer should have seen the logical extenstion, and contradiction inherent in that statement. Khaiyum is a big pretence of being an intellectual. Statements like this gives him away.

The whole world knows that Bainimarama Government is born out of the tradition.It is the product of military intervention and removal of a legitimate Government elected by the people.Khaiyum ought to understand that....VB and Khai would never be there under normal circumstances...Both have huge security detail-They are scared to their spines.If they have not done anything wrong,why so many body guards surround them to everywhere they go.What is the problem?With those many guards around you even people like Chandu Umaria can talk like that...and the elections you are talking of was designed to fail the majority,anyway.OK.

Looks like AK-47 isn't quite up to date on his self-made laws that normal circumstances would have prevented him and his puppet from achieving totalitarian rule.
