"Mary Hell" for Pupils: Fareed allegedly claimed Bainimarama's wife Mary sent in military goons to interrogate the primary students about iPad!
I have taken the liberty to cc all FHL & Fiji TV board members, FHL Class B Shareholders, Hari Punja & Sons Shareholders & Acting PS, PM's Office & the Co Secs of both Companies including the Acting CEO of Fiji TV. Acting PS PM's Office - please ensure that the Hon Prime Minister, Ratu Josaia Bainimarama MP is given the copies of our email last week & the one today
Fareed, I had clearly told you that whenever a false, wrong & LYING statement comes out from you, I will release the TRUTH. Given that you are the G/CEO of a Taukei public listed institution, the FHL board members including the FHL Class B Shareholders must be made fully aware of all wrong, illegal,unethical, un-truthful and unrighteousness statements, acts & conducts that you make. The board members have a legal fiduciary duty to act upon a serious allegation which is made against you given that you are heading an institution that advises its shareholders on investments. Their failure to act against you is negligence on their part. The 74 page report is already clear evidence of serious misconduct against you which they should have acted upon - not withstanding as well my email to you all last week.
This email is in response to the Fiji TV Media Release dated 5th February, 2015. There were 8 listed paragraphs in the Fiji TV statement, we will address & respond to each & everyone.
1. Fiji TV para 1 : Fiji TV categorically refutes allegations of wrong doing which have been alleged by two former employees, Tanya Waqanika & Tevita Gonelevu
Gonelevu & Waqanika response :
We stand by our detailed 74 page report with supporting evidence to the Hon Prime Minister and all those copied in the report. The report is circulated through out Govt, all Members of Parliament, Military, Private Sector, all Fijians in Fiji & abroad. Copies are also with the Senior Police detectives that took our Police Statements on Tuesday, 3rd Feb, 2015.
2. Fiji TV para 2 : The decision to terminate the two employees or pressure was made by a duly constituted Board of Fiji TV without any interference, direction of the Attorney General, Hon Aiyaz Sayed - Khaiyum, Solicitor General, Sharvada Sharma and Acting Senor Legal Officer, Tupou Baravilala.
Gonelevu & Waqanika response :
Duly Constituted Fiji TV board meeting- we stand by our statement (you must remember, Gonelevu & Waqanika have also done extensive Company Secretary work for FHL & Fiji TV respectively & are well versed with processes & procedures of Board Meetings, AGMs, Articles of Associations, etc) and we stand by our statements that there was no proper constituted board when our employment contracts were terminated - refer you to the Fiji TV Articles. You see, once the Fiji TV board members are summoned to a Court of Law, they have a moral,ethical & legal obligation to swear & state under oath, the truth on this issue & also the items that were discussed in the FHL boardroom on our removal. To state otherwise is perjury and this is a criminal offense. On a personal & professional level, your fellow FTV board members will not lie to save another lie given that they have their own families, children, profession, dignity & their own integrity to state the truth unlike YOU!!.
3. Fiji TV para 3 : Furthermore, the decision by FTV to sub - license its exclusive rights with regards to Rugby Events was taken exclusively by FTV & there was no interference, direction & pressure by the the Attorney General, Solicitor General & Tupou Baravilala.
3.1 It was always clear to the Fiji TV Board and Executives including the current Content Manager, Karen Lobendahn that we were never going to breach the Decree. This is recorded in the meeting meetings taken by Siwatibau & Sloan (Fiji TV Annexure 2). It was always clear as well that if FBC failed to pay Fiji TV, the feed will never go to them given that we all had a legal fiduciary duty to protect Fiji TV and its shareholders. We know of the Judases that leaked information to AG on this issue - their conduct tantamount to summarily dismissal. Only 2 people at FTV were given all my corresponding emails to WR - once their emails surfaces, again it will reconfirm the Judas that leaked Fiji TV company information to the AG.
3.2 Fiji TV letter of 3rd Dec - I refer your lying memory again to page 7 of our report. Gonelevu, Waqanika, Naiveli & Roxburgh will not lie when we saw with our own eyes when AG himself pulled out the hard copy letter and stated equivocally that Fiji TV will sign the letter - totally against Fiji TV & its shareholders interest. The same letter was emailed from Tupou Baravilala to Fiji TV - we all saw it. Unless you are now suffering from dementia,we all witnessed the unethical conduct of the AG in front of the Fiji TV team and SG & Tupou Baravilala.
4. Fiji TV para 4 : Any decision taken by FTV or any correspondence issued by FTV was solely a decision by FTV, in the best interest of the company.
Gonelevu & Waqanika response :
Refer your lying memory to Fiji TV annexure 11 where Fiji TV board member, Gary Callaghan (pages 65 - 67) clearly states that your conduct including Naiveli was not in the interest of Fiji TV. The original sub license agreement which was prepared by the Fiji TV team with Fiji TV external solicitors, Siwatibau & Sloan, was circulated to everyone including you for your approval- YOU ALL APPROVED.
The 2nd sub - license agreement which was not prepared (internal), discussed, viewed & approved by Fiji TV board which you & Naiveli went & signed with FBC was clearly not in the interest of Fiji TV. These copies will be surely be submitted in a Court of Law - your signed contractual version is not in commercial favor to Fiji TV.
FHL board members & Class B FHL board members, we urge you to call for these 2 contracts & have a look at it. Your FHL CEO & Chairperson FHL did not act in the interest of the FHL Shareholders. These are serious legal implications & consequences which has affected FHL shares.
5. Fiji TV para 5 : FTV was not at any time coerced by the Attorney General, Solicitor General or any other officer.
Gonelevu & Waqanika response :
Refer your lying memory again to page 7 & 8 of our Report. We also refer you to Fiji TV 1 (your SMS to me clearly stating AG's instructions to you). Please note that Gonelevu also received the same SMS including the Fiji TV board members. We also refer you to annexure Fiji TV 6 - your emails to the Fiji TV board members & Executives clearly stating the directive from the AG.
If you are stating otherwise as signed by the press release of 5th Feb, 2015 - are you now stating for the record "that you were in fact LYING & IMPERSONATING the AG all along when you sent the SMS & emails to the Fiji TV board & Executives"??? Impersonation is a criminal offence (s356 Crime Decree) & carries a sentence of 1 year imprisonment. If this is so - your entire conduct is malicious & damaging to Fiji TV!!!
6. Fiji TV para 6 : Fiji TV categorically refutes allegations made by the two former employees with respect to sharing of the Rugby events and state such statements are clearly malicious, emotional & without any basis.
Gonelevu & Waqanika response :
All our recorded statements & the 74 page report since our employment termination have been made to protect Fiji TV & its people. Waqanika does admit that she did a FB posting where she clearly states that it would be in the best interest of an advertiser to advertise solely with Fiji TV for all WR events given that the feed from WR only goes to FTV. FTV will only release the feed to FBC upon FULL payment prior to each leg of the WR 7s series. Failure to pay by FBC will result in the feed not going & the advertiser runs a commercial risk. Secondly, Waqanika clearly stated that Fiji TV has a "widem & better coverage reach than FBC which adds value to an advertisers product. Coverage & Reach of all three broadcasters is detailed in our 74 page report.
Given that you have used the words 'malicious & emotional', you have forced my hand to reveal 2 issues outside the scope of this email :
a) our telephone conversations between Waqanika/Fareed prior to your confirmation as CEO FHL. You called me & expressed your concerns & disappointment that you were still the Acting CEO FHL. We discussed a lot of things but the one I clearly remember to this day & which I have shared with a few people was your request to me that the Fiji TV newsroom cover the story of the the Yat Sen Students that were taken to the police station for questioning as a result of a missing laptop/ipad. Your children are current students of the school. You mentioned in detailed the involvement of the Hon PM's wife sending soldiers, etc to the school...it certainly would have been a traumatic experience for any child or school for that matter.
The owner of this missing item is one of the Hon PM's granddaughter. Their mother & Na Levu, unbeknown to you & many, are friends of mine till today (marama nite). I told you on the phone - "when it comes to children, regardless of whose child or grandchild, it is a "No go Zone for the media". Fiji TV did not cover the story.
b) The removal of Carl Ngamoki - Cameron : whilst the FHL board meeting was still going in & when it was decided that Carl be removed, you called me & our newsroom & requested for media coverage immediately outside FHL foyer (I could hear the board members still discussing board matters), by then our newsroom including other reporters were making there way to FHL). You whispered on your cell that Carl's FHL board membership was terminated forthwith. Your actions & conduct on that day shows your unprofessionalism. Your loyalty is only to yourself & no other, which we had clearly recorded in our last Fiji TV Executive/Management meeting with you. I have no doubt that if any of your FHL, Fiji TV or AG himself is removed - the media can always count on you to give the inside scoop.
c) Frankjosh email : former FHL board members and perhaps some current ones have confirmed you tabling email directives from this email address. One former FHL board member told us that one of the directives was to confirm you as CEO FHL.
7. Fiji TV para 7 : These statements are a clear indication of disgruntled former employees as a result of decision taken by FTV in the best interest of the company
Gonelevu & Waqanika response :
We have to state the FACT in its entire truth and righteousness. Perhaps our dismissal was in your best interest but why was Gonelevu & Waqanika the only 2 Executives singled out? Why did you not remove the current Head of Corporate/Finance (whom who deployed from FHL to join FTV) who has breached Fiji TV policy - I had told him off in the presence of other Fiji TV Executives that the giving of SKY Pacific complimentary to a gym which he is a member of and not declaring his interest was dishonest. Also the mere fact that the Gym was not an advertiser with Fiji TV compared to USP & Fiji Sports Council was ethically wrong. You knew about this because I had discussed with you prior to my removal. He was one of the Judases which you confirmed to me on email. His performance reflects in Fiji TV's financial results for FY 2013/14 - a LOSS!!
8. Fiji TV para 8 : Perhaps the employees should refer to their employment contact which is clear on terms of engagement & termination
Gonelevu & Waqanika response :
We have read our contracts & we agree that Fiji TV can invoke the "no Cause Provision" but the right to a fair hearing & natural justice/process was not accorded to us, something that we will discuss further in Court.
If the same provision is also in your current employment contract & given the damaging, serious & overwhelming employment & criminal breaches committed by you - I challenge the FHL board to invoke the same clause on you as well immediately.
Conclusion
Just some questions, which we pose to you?
- How long will you continue to protect a LIE?
- How long will you continue to protect the LIES of the AG?
- How long will you continue before you realize that it is too late?
- Are you willing to lose your job,your family & your freedom to protect the LIES?
We have already lodged our complaints to Central Police Station. We will also lodge the same against you. In my personal view, no other Fiji TV board members are liable for criminal prosecution, but I may be wrong. I am no criminal lawyer expert. However, in terms of civil proceedings - the FTV/FHL individual board members will be a party to our claim.
I will liaise with Lateef & Lateef this morning & our on going shortfall salary payout & my bonus which we are legally entitled too. Hopefully, we get some good news today
Personal note : when it comes to LIES from you, Gonelevu & Waqanika will spiritually discern it as God's children.
Further, the Taukeis who are all copied on this email know the traditional links & ties of our noble mothers from the Vanua, Rewa - Ro Elenoa Cuanilawa Gonelevu, Marama Roko Tui Matai from Burebasaga, Rewa & Ro Luisa Waqanika (nee Buresova ), Marama Sauturaga & Yavusa Vasu, Lomanikoro Rewa - o rau na marama veimataki. As part Rewans - we will always catch a LIE.
