"A Fiji Commerce Commission (FCC) officer was assaulted by a trader today in Lautoka after issuing a spot fine of $1000 to Asha’s Restaurant and Milk Bar for failing to properly display prices on goods. After leaving the trader’s premises to return to the commission office in Lautoka, a company director, Vicky Vikash Kumar, allegedly followed and then punched one of the FCC officers in the Fiji Commerce Commission car park. The incident is currently with the Police for further investigation."

While he was lying on the ground  Francis Kean  kicked him on the chest. The accused was dragged away by an unidentified woman but returned to kick John Whippy’s head...Your serious loss of self-control also aggravates this crime...Kicking this man when he was down demonstrates to me that this was an attack of considerable ferocity. You lost your temper. You resorted to violence. You had to be dragged away from your victim. Whippy died."  Justice Gerard Winter as he jailed Francis Kean for 18 months; Kean is now new Prison Commissioner


Fiji Commerce Commission Officer Assaulted, AG Issues Stern Warning

A Fiji Commerce Commission (FCC) officer was assaulted by a trader today in Lautoka after issuing a spot fine to Asha’s Restaurant and Milk Bar for failing to properly display prices on goods.

In response, Attorney-General and Minister for Finance Hon. Aiyaz Sayed-Khaiyum has issued a stern warning to all businesses not to interfere with the FCC’s work of protecting consumers and preventing unethical trading practices.

At the incident in question, an FCC officer was assaulted after issuing a spot of fine of $1,000 to Asha’s Restaurant and Milk Bar for failing to properly display prices on tin fish, tea leaves, flour, noodles and breakfast crackers.

Hon. Sayed-Khaiyum said that the trader was first visited by FCC officers on Friday 4 March 2016 after reports from consumers that the merchant was practicing unethical behaviour.

FCC officers found the trader to have violated the Commerce Commission Decree 2010 by engaging in price gouging, failing to mark/display prices and failing to issue receipts. As a result, the merchant was issued a spot fine of $2,000.

FCC officers returned to Asha’s Restaurant and Milk Bar today after continued reports that prices were not being properly marked and displayed. FCC officers again found the trader to be in violation of the Commerce Commission Decree and another $1,000 fine was imposed.

After leaving the trader’s premises to return to the commission office in Lautoka, a company director, Vicky Vikash Kumar, allegedly followed and then punched one of the FCC officers in the Fiji Commerce Commission car park. The incident is currently with the Police for further investigation.

“This alleged behaviour is shameful and will not be tolerated. Any person who seeks to hinder, obstruct or otherwise interfere with the FCC’s critical work of protecting Fijian customers will be punished to the full extent of the law. The FCC will continue responding to reports of unethical practices and rooting out traders who seek to exploit our consumers. I assume the officer who was punched was a small Indo- Fijian . Would the macho business man have done that if it was a military wallah ? No, then he'd be shitting his pants.

What this rogue trader did was to show arrogant disregard and disrespect for rules and established norms . But he is not alone in doing that. The difference is that in the " new " Fiji of Bainimarama and Khaiyum's design where everyone is "equal " some can get away with it and some can't . And we know who are the ones who have disregarded the rules, even the constitution, and got away with it. That might well be the source of the trader's frustration. But no excuse for him to then punch a lowly official who is just doing his frontline job.

what you morons are missing is that tin fish is what Fijian people survive on, nothing to do with the P M or attorney general you guys have no idea stupid fools!

The point is one particular Fijian with all the resources is sadly dependent on tin fish and the other types actually go catch the live ones. What price fish? that is for PM & K to decide, but punching or abusing any officer or fellow citizen over a dispute is an absolute no! no! and the point is well taken; some offenders get punished by law while others who needed to be locked up are set free and other types evading the law legally by Govt. approval...by rank & Keanship (no pun)

I can understand the business owner's frustration. Why slap him with $1,000 in a fine. Why not issue him with a summons and let an independent body such as the judiciary to decide the level of fine based on the circumstances of the case. He could be a first offender or the label could have fallen off. Its typical of the Bainimarama Govt where they try to squeeze revenue from the hard working battler such as store keepeers, vehicle owners via the LTA,, etc etc while they reduce tax on high income earners from 33% to 22% and favour big business cronies
