SUSPENDED Opposition Parliamentarian, Ratu Isoa Tikoca is now a free man after he was acquitted of charges of failing to declare his declare his liabilities before the 2014 General Election by the Suva Magistrates Court

Ratu Isoa appeared before Magistrate Waleen George.

He was alleged to have incurred more than $94,000 to the Fijian Government while serving as Fiji�s High Commission to PNG.

In her judgment, Magistrate George said the Prosecution has failed to prove their case and therefore Ratu Isoa was acquitted of the charge accordingly.

In an interview outside the courtroom, a relieved Ratu Isoa said the truth would always set one free and that was the case for him. Source: Fiji Times

AFTER WE HAD COLLECTED ENOUGH EVIDENCE AGAINST HIM HE WAS CHARGED ON THE DIRECTION OF HON PM FRANK BAINIMARAMA AS BY THEN AG AIYAZ SAYED-KHAIYUM INTERFERED WITH THE INVESTIGATIONS. PRESENT LANDS MINISTER FAIYAZ KOYA WHO WAS NOT IN THE GOVERNMENT THEN WAS ALSO INVOLVED.

WHAT HAPPENED AFTER ABBAS WAS CHARGED I WILL EXPOSE HOW AG AIYAZ SAYED-KHAIYUM AND NAZAHAT SHAMEEM THROUGH SSP RAVI NARAYAN SYSTEMICALLY MANIPULATED THE COURSE OF JUSTICE TO GET HIM THE FREEDOM.

"There is a criminal case file sitting in a district court in Fiji ready for hearing if not mention. The charges on that file is serious.
Causing death by dangerous driving and careless and reckless driving.
I made an effort to go through similar cases in the last five years. Since the charges are deemed serious, the punishment dished out by the courts or judiciary previously is moderate if not harsh. In most instance the trail judge while delivering the verdict has said that a deterrent sentence is warranted to pass a message that the court will not take causing death by dangerous/ careless driving lightly. Thus a jail term or a conviction is sought. Suspended sentence has not been an option, forget about a discharge without conviction verdict.
Fiji First party Minister or Minister for Local Govt Praveen Kumar Bala has similar charges against him. His file is almost at the doorstep of the court.
It cannot or can't or does not have an option for further date mention or adjournment. It needs to be heard, dwelled and judgement issued.
I can say with confidence that Fiji's justice system is rigid and this case will further solidify the faith we have in the rule of the land.
Justice delayed is Justice denied. One or similar rule for everyone. Dont you agree?.
MY COMMENT NO. 1
Yes this case has been long overdue to be dealt with. Someone is pulling the strings in delaying the process so that no witnesses are around to give evidence. The Attorney General AIYAZ SAYED-KHAIYUM cannot deny the fact that he is unaware of the case against the Minister. Apart from this charges against PRAVEEN BALA the Attorney General AIYAZ SAYED-KHAIYUM very well knew of his illegal activities because I had personally briefed him. I had also briefed the former CP Teleni and his deputy Eroni Antonio and had showed evidence against PRAVEEN BALA and others for their involvement in 2000Coup and the attempt to kill the Commander Bainimarama. The rest is history and I was stopped from directing Investigations not only in the 2000Coup, Mutiny to kill the Commander, other serious cases of Corruption and Fraud by Police Officers and other former Government Ministers and Senior Managers in Government. This was against the mandate of HE then the President of the Republic of Fiji late RATU JOSEFA ILOILO when he appointed the Interim Government in 2007. Those responsible for their attempt to have the foreign troops to invade Fiji and levy war against RFMF whilst the HE was still in the Office and had never authorised it, also escaped Justice. Instead quite a number of Senior Military Officers who rose to protect the Country were gradually taken to task or trapped by the Corrupt. Even to the extent the Corrupt Police Officers had attempted to trap the Commander Bainimarama with the help of a High Court Judge. She had been involved in suppressing evidence in NBF Scam, Savua cases, 2000Coup and Mutiny to kill the Commander and other serious cases.Cases also including Corrupt Police Officers. Irony of the situation is, there are quite a number of the Corrupt and those involved in major serious cases were given ticket to be become part of the present Government.

The magistrate who acquitted the Suspended opposition parliamentarian is not likely to keep her job for too long. The law is used by the mob in power as a stick to beat up opponents and critics of their rule. It is no longer meant to deliver justice. If delivering justice was what the law was about Khaiyum and his sidekicks would have been hauled to court. The law is applied selectively . Everyone is not equal before the law. Some like Khaiyum and his crooked cronies are more equal, The magistrate has apparently not read the script about the drama of law in Fiji.

By May 2009 more than twenty-eight hours had been spent in the Nadi Magistrates and Lautoka High Court assisting a British visitor to Fiji who was attacked at 0200 hrs in Nadi by a Gang of Four who had driven around from Suva on what the female member termed in court as 'A Joyride'. In this assault, the visitor to Fiji lost an eye and subsequently his Pilot's Licence. They were all admittedly the worse for wear due to level of alcohol consumed: Fiji's number one curse. When the FICAC Team came in to Suva, they were informed (informally over Morning Tea) about this case. The reply of leading Counsel from Washinton DC was helpful. Clear sign of serious corruption. Ultimately, the Resident Nadi Magistrate was charged and jailed. A trail of complaints had followed about his time in Labasa. This scenario was 'for starters'. Endemic corruption resembles a Spanish Onion: keep peeling away only to reveal more....... into infinity. But the Abrogation of the Constitution was an enabling factor for far more serious and disturbing events.

A perplexing ruling. The Opposition parliamentarian is guilty as hell. One wonders if a deal was done? What did the member pledge in return for an acquittal?

Congratulations to Hon Ratu Isoa Tikoca. WE also say congratulations to the magistrate who knows what a judicial oath means, to fearlessly administer justice. Yes, she might be showed the door, I hope not for sake of humble justice. The humble magistrate has been able to give a quick decision, "justice seen to be done". Thank you. Our superior courts appear unable to come to a decision on Constitutional cases involving Govt throwing opposition members out of Parliament. One would have thought that public interest cases should be dealt with haste. The Government of FFP had tried to destroy Ratu Tikoca, an effective member of the opposition and possibly a member of government in the next parliament, if the votes are not stolen. He was got under their skin of the One and only. The Vindictive Man, on man band had to teach Ratu a lesson. The FFP Govt has successfully disfranchised Qarase and Mahendra Chaudhary and attempting to do so with Dr Ganesh Chand, an eminent academic and administrator with a keen political instinct. . They tried to demoralise and silence the high Chief, Ratu Naiqama. But the One man Parliament has his last laugh. We just sit and watch his immense power that rivals no others, even in the military, given to HIM, the almighty omnipotent, courtesy of no school bully, the real Commander of the RFMF, the Admiral, the President of Cop23. The present Fijian Parliament could be the only Parliament which can throw opposition members out of Parliament for years, must be a record with 3 members ousted in one term. What a distinction. Let us not give up hope, This magistrate has brought back some hope to us that "we shall overcome some day".

I agree with what you say. The magistrate in this case must indeed be congratulated for showing courage in applying the law fairly without fear and favour. That's not an easy thing to do in the compromised justice system in Khaiyum and Bainimarama's " New Fiji ". But I don't want to be overly optimistic. One swallow does not a spring make. The dominant trend in our law courts in post coup Fiji has been that it has come to be under the thump and diktat of the rogue rulers of the country who use the court to punish their detractors and opponents.

In the French parliamentary elections many in the suburbs preoccupied with the struggles of daily living are disenchanted with politics . One said " Politics is all lies. Everyone knows that". ( Aljazeera news 17/6 ).
We have certainly come to know that since our country became a coup country.
People lied to grab power and then lied to hold on to power.
Lying has become the new norm in politics - politics of the dirty variety.

We read in smh 19/6 article ' Labour MP filed documents for billionaire ALP donor's Chinese business association' that Billionaire Huaung Xiangmo's political influence has extended directly into the NSW parliament with revelations that a serving NSW MP filed documents for an organisation headed by the Chinese Communist party- aligned businessman while acting as its adviser.
Labour MP Ernest Wong filed and signed off to n financial documents for the Australian Guangdong Chamber of Commerce headed by two major Labor donors, including Mr Huaung.

Doing the Right thing.
The magistrate Waleen George did the right thing. She upheld her oath of judicial office and applied the law impartially without coming under the sway of her political masters.
That is as should be if the people are to trust and have confidence in the judicial system in post coup Fiji.
Here is a letter written by John Fitzsimmons titled 'Doing the right thing' ( The Age 19/6 ) that succinctly captures this theme.
"Sometimes we face difficulty in life not because what we are doing is wrong, but because what we are doing is right. Gillian Triggs is a case in point of a public servant who provided Frank and fearless advise to the Coalition government in her role as President of the Human Rights Commission ( ' Lauded and vilified ' The Age 17/6 ).
The basis of Attorney General George Brandis' tirade against Gillian Triggs was that the report she tabled to Parliament regarding children in detention, did not augur well for the Coalition government. Put simply, it made them " look bad ".
However, making the government " look good " to Australians was not what Gillian Triggs signed up for, but rather to observe the provisions in her statutory mandate of " speaking out if particular acts are contrary to Australia's obligations under international law. " A finding of fact that is now clearly irrefutable ".
Have some of our mob in the Fiji Human Rights Commission and elsewhere in the governmental system in post coup Fiji signed up to serve according to their oath of office or according to the diktat of their political masters to make them " look good "?
They did not sign up as opportunists for their own self-aggrandisement,did they?

Why The Courts Exist If Not To Protect People From Unfair Treatment.
That's precisely what the three judge federal appeals court in the US did when it agreed with 2 tribes who challenged a Freeport Minerals plan to divert water from the Gila River, saying the company had failed to show that its proposal would not affect the tribes.
The court said the company did not meet its burden of proving that the plan to reroute water would not have substantial negative effects on those downstream...
It's nice when the court does what it is meant to do.
Unfortunately that does not happen in some places where court officials forget their proper role and responsibility.
And in other places the State in collusion with big companies ride roughshod over the rights of ordinary people and their resources.

A Mayor Who Falls Foul Of The Law.
Former Ipswich mayor Paul Pisasale has been arrested and is to be charged for extortion and the assault of a woman. This follows questioning by the Crime and Corruption Commission ( abc news 21/6).
Mr Pisasale was first elected to council in 1991 and since 2004 has served four terms as mayor. In the 2016 election he was reelected with more than 80% of the vote.
The good thing about the democracy we have in Australia is that you can be a former or current mayor or some other big shot local government or national politician but if you fall foul of the law then your status can't save you.
The relevant authorities will do their duty to bring you to justice as they are mandated to do.
We don't have justice administered Animal Farm style whereby some are regarded more equal than others.
Is it the same in the democracy Fiji has following Bainimarama's coup?
