$125,000 TO BUS FIRE VICTIMS

A NASINU man and his grandson who were travelling on a Raiwaqa Buses Ltd vehicle, which caught fire and resulted in the deaths of 12 people in 2008, have been awarded $50,000 and $75,000 in damages by the High Court in Suva.

Justice Lyone Seneviratne, in his September 30 judgement, ordered that Raiwaqa Buses Ltd and driver Kaminieli Tuimavana pay Sakiusa Soli and his grandson and namesake, Sakiusa Soli, for general damages.

However, the High Court judge dismissed the plaintiffs’ claims against New India Assurance Company Ltd.

The court also ordered Raiwaqa Buses Ltd and Mr Tuimavana pay $7500 in court costs.

During proceedings, it was revealed Mr Soli Sr escaped the burning bus through a sliding window and he managed to take his six-year-old grandson with him.

The grandfather had testified in court his fingers were burnt and “bones were visible” and Mr Soli Jr had suffered burns to his body.

The court observed 12 years after the accident, they both carried scars on their bodies.

Mr Soli Sr said he experienced memory loss and could not lift heavy things.

Mr Soli Jr said he forgot things and still dreamed about the fire whenever he smelt smoke.

“As I always say, there is no relationship between pain and money,” said Justice Seneviratne.

“The court has to award an amount for pain and suffering arbitrarily but such amount must be reasonable.”

Extortion yet again alongside compensation, no wonder RBL buses are very expensive for hire that they can't even check their vehicles thoroughly for pests like those roaches.
