SHIRLEY PARK LEGAL BATTLE UPDATE: Lautoka City Council lawyers fail  to turn up in court and park supporters now have to wait until 15 July

* The case was called on Wednesday 8 July 2015 at the Lautoka High Court. On the last occasion the court had directed that Lautoka City Council (LCC) file submission by 6 July 2015 and all plaintiffs file submissions by 7 July 2015.  The court was to make a ruling on 8 July 2015.

* Due to LCC not filing submissions by the specified date, the plaintiffs (that's the Shirley Park supporters) were not in a position to file their submissions since they did not know what were LCC's grounds of asking for the application to be struck out.

* The matter has been adjourned to Wednesday 15 July 2015 at 9am.  The plaintiffs have been given till Monday 13 July 2015 to file  submissions. 

* The action was originally filed to be an Ex-Parte case, which would have meant that the Shirley Park supporters only appeared before the Judge to get interim orders. 

* However, strangely enough, the Judge changed things and made the action Inter-Parte which brought all parties to court on the first day of the matter.

* Documents were served at the Attorney General's Chambers. 

* The park supporters attempt to serve documents at the office of the Director Town and Country Planning and Lautoka City Council was unsuccessful since both offices refused to accept service.

* The documents had to be left at their respective receptions on Wednesday 1 July 2015, regardless of them accepting or refusing service.

The courts in Fiji remain under the thumb of the mob in power. The same mob who imposed dictatorial rule in Fiji for 8 years. Fiji has returned to democracy but the dictator still holds sway . The court is there to do his bidding. The legal proceedings is just for show to show the world that there is rule of law in Fiji.

Question: How many Chinese Walls do the Shirley Park Supporters need to climb over or break through?, just as they get past one, another appears. Scandalous behaviour by some of the legal profession, the Master Piper plays the tune that they willingly dance to.

Let me explain the Shirley Park " re zoning " story. The gang who had grabbed power unlawfully in the country under the false pretence of cleaning up on corruption and bad governance very smartly got into bed with the same corrupt business class . This Shirley Park deal is evidence of one of the several the Bainimarama Khaiyum regime approved for their political backers. They had made an apriori decision to grant approval for the re zoning. The pretence of public consultation came only after public protest. And, they thought they could manage and manipulate to ride the protest but that did not happen. Conscientious citizens took the matter to court. Now the pretend democracy is showing its true form through the cynical manipulation of the court and legal process.

Having influential - that is powerful - politicians in their pocket is a " business art " the big business wallahs in Fiji as elsewhere have long cultivated. That businessman- politician connection remains alive and well under the Bainimarama government. No paradigm shift there!
