The Saffron Brigade are also circulating among Hindus copies of a Letter to the Editor in Fiji Times that the then student Khaiyum had written from Hong Kong criticizing the Fiji Muslim League
. The Koya brothers: one is Speaker of FML, and the new A-G and Minister of Justice is a trustee of the League.

Letter: Critique of FML decision to make submission to Constitution Commission

by A S Khaiyum
(Letter from A S Khaiyum)

"The claim by some executive members of the Fiji Muslim League ('League') that Muslims support a review of our Constitution and demand separate seats merely because the executive says so is a gross misrepresentation of the views of the everyday and majority of Muslims in our country.

The executive lack the mandate to speak as a representative body for Muslims since the League has been and is essentially an administrative institution managing and maintaining mosques, schools, orphanages, a sugar cane farm and real estate.

In addition to the lack of mandate the arguments and justifications espoused by the executive for a review and separate seats are flawed. They are flawed because our Constitution, in particular the Bill of Rights, namely sections 38(2) and 35 more than adequately guarantee and protect religious freedom and minority rights. Indeed if an almost identical South African Bill of Rights provision protects the rights of the minority South African Muslims then what is so special about and differentiates Muslims in Fiji?

On the basis that last century the then nascent League made submissions on separate seats, it is argued today that so called Muslim rights will be achieved if these seats as submitted then are allocated now. To refer to a resolution passed some seventy years ago, in an era with its own specificities and dynamics, as justification for separate seats in today's Fiji illustrates a complete ignorance and denial of our political, social and constitutional history/experience as a nation-state.

Indeed if we were to hark back and uphold the standards of 1929 then commoner indigenous Fijians and women would not have the right to vote. Fiji and the rest of the world have moved along. Clearly such absurd referrals to the past illustrate an enormous vacuum in basic critical thinking and analysis, discourse and a general prevalence of obscurantism within the executive.

Furthermore, it aptly demonstrates a complete ignorance of contemporary developments in and interpretations of Islamic law and jurisprudence vis-a-vis constitutional, human rights and international law and conventions. More tragically, however, the opportunism of the executive displays the absence of and lack of belief in justice, compassion, selflessness and basic human decency.

Most Muslims in Fiji know that certain officials treat the League and its branches as their own little fiefdoms. Fiefdoms, where nepotism is known to be rampant at most times; where certain families and individuals have reigned as executives literally for decades; where children and families of well-to-do officials benefit from scholarships which were and are meant for poor students; where chairs of numerous committees are held by single individuals; where businessmen and business interests are over represented; where women, the youth, various provinces and other denominations are either underrepresented or not represented at all; where appeals to religious dogma and unity are utilized in response to queries of administrative/financial discrepancies and where certain individuals view the League merely as a means to acquire access to power, influence and ultimately money - all under the guise of "protecting Muslim interests."

Indeed the absence of proper representation, transparency, accountability and ultimately legitimacy also plague other local institutions in contemporary Fiji.

The executive of the League cannot and does not represent the political opinion, views, philosophies of individuals or the bulk of Muslims in Fiji. These self appointed guardians do not speak for the masses.
Therefore, the current administration and all Fiji Islanders must understand and recognize the majority of Muslims who believe in basic human decency, justice, democracy and constitutionalism reject the idea of separate seats and/or a review of our Constitution."

US Ambassador Larry Dinger to Washington, 7 July 2007: "Aiyaz Sayed-Khaiyum, Interim Attorney General and Minister for Justice. Khaiyum, a Muslim, is a young Suva lawyer who was General Counsel of the Colonial Group of Companies, President of the Fiji Young Lawyers Association, and a board member of Transparency International Fiji. His brother Riaz is a TV journalist in New Zealand. Khaiyum has had an excellent reputation. While a student at the University of Hong Kong in 2001, he wrote an open letter decrying corruption within the Fiji Muslim League. After the swearing in, Khaiyum said his portfolio includes "anti-corruption and electoral reform." He said there is no specific time frame for elections." - Source Wikileaks.

No wonder They invite them to the swearing in ceremony at Government House.

Hon A.S.Khaiyum should sack Sudhakar as MP as we have another 17 candidates to choose from.

just because some men are suited up in coat and tie and carry titles like MP or Minister and go to Government House for swearing in an oath and all that does not mean they are honest, respectable men of integrity.

Aiyaz actually wanted to take an Oath on his Thesis -

But what hypocritical Oath is this Man Taking?

Aiyaz is without any morals or scruples - an intellectual property thief (CHOR) -

Aiyaz has already bashed the Fiji's 1997 Constitution - He is no respecter of any Constitution - even his own!

game's not over until it's over. and, in fiji politics the game is still on. aiyaz and his team is winning at the present time by getting away with the numerous professional and cynical fouls they have committed. but the tide can change as it often does when the opponents come from behind despite all the disadvantages, the odds to take the upper hand.

Khaiyum CONFIRMED 1997 Constitution guranteed religous freedom
25/9/2014 04:02:46 pm

It is Aiyaz Khayum who confirmed to the Fiji Islanders and Governemnt of the day that the 1997 Constitution was adequate for religous freedom to minority groups.

"In addition to the lack of mandate the arguments and justifications espoused by the executive for a review and separate seats are flawed. They are flawed because our Constitution, in particular the Bill of Rights, namely sections 38(2) and 35 more than adequately guarantee and protect religious freedom and minority rights"

This makes his 2013 Constitution BLUFF and full of LIES just like his elecoral fraud.

Khaiyum - "Majority Muslims rejected review of 1997 Constitution"

Khaiyum's Yash Ghai and his 2013 Constitution is a BLUFF - confirmed by Khaiyum's own public outcry rejecting calls by Muslim League to seek amendments to the 1997 Constitution.

"Indeed the absence of proper representation, transparency, accountability and ultimately legitimacy also plague other local institutions in contemporary Fiji."

The executive of the League cannot and does not represent the political opinion, views, philosophies of individuals or the bulk of Muslims in Fiji. These self appointed guardians do not speak for the masses.

the absence of proper representation, transparency, accountability, legitimacy and public scrutiny and the presence of nepotism, favouritism, corruption and arbitrary rule were the hallmarks of the Bainimarama-Khaiyum regime in Fiji for the last 8 years. I bet Aiyaz didn't notice that!

Finance Minister to handout excessive RFMF budget to gain ultimate legitamacy

Khaiyum told whole Fiji from Hong Kong when he was studying there that:

"Indeed the absence of proper representation, transparency, accountability and ultimately legitimacy also plague other local institutions in contemporary Fiji."

Now Aiyaz seeks legitamacy to his own 2013 Constitution by sitting in Finance to fiddle the fianance and to delete last 6 years of corruption history to gain legitamacy.

what proper procedures link

In a letter to the Fiji Times (26/09) one Tessa Mackenzie tells us she is " wondering why the proper procedures for the election of a Speaker, as laid down in the 2013 Constitution, were not followed".
Not following proper procedures and disregarding the Constitution has been pretty much the norm of the Bainimarama-Khaiyum dictatorship for the last 8 years. I wonder if Mackenzie has noticed that?
Remember leopards don't changes their spots. The constitution the dictatorship designed is for show only and to hound opponents. It will be bend whenever it suits the dictator who is now the "democratically elected" PM of Fiji. The dictator will continue to do what a dictator does - now with greater impunity because he is the "legitimate" and " democratic" leader of the country.

Aiyaz, your own lack of belief in justice is what YOU have decreed that your crimes are not challengeable in Court of Law.

This is what you wrote about lack of beief is justice, etc telling the Fijians in letters to editor:

"Furthermore, it aptly demonstrates a complete ignorance of contemporary developments in and interpretations of Islamic law and jurisprudence vis-a-vis constitutional, human rights and international law and conventions. More tragically, however, the opportunism of the executive displays the absence of and lack of belief in justice, compassion, selflessness and basic human decency."

Then how does CJ Tony Gates claim judiciary is independent when the governing law is that the President of Court of Appeal must make rules of court within the limitations of the 1997 Constitution, no matter the abbrogation of the constitution as it was Justice Tony Gates who gave judgment that no man can tear the constitution.

So you Mr Aiaz and Tony Gates, when your own previous opinions have gone unchallenged, your knowledge in this matter can only be construed to mean purported abbrogation is the first count of criminal deception. And decree that registra cannot accept case against the IG, is aiding and abetting course of justice.

Then when matters raised in the court during other hearing, the law pertaining at time of crime or in civil matter, it is Tony Gates Court that refuses to hear case according to laws relevant to the case, with failure to make court procedures to be within the bounds of the 1997 constitution, means abuse of office, and aiding and abetting abuse of office.

The Khaiyum in HK seems a good man. He is an enlightened Khaiyum.

Notice how easily ‘bill of rights’ provisions of the 1997 Constitution -is not only praised and quoted- but also freely practiced in Khaiyum’s own freedom of critical thought, speech and expression.

Khaiyum was then a PROUD protector of our 1997 Constitution and a true patriotic Fijian.

That was then. That was before he SOLD his SOUL.

That was before the time when Khaiyum “willfully deceived and induced an elderly and ailing President (Iloilo) to ‘purportedly’ abrogate the 1997 Constitution” [Fiji First Party – supplementary submissions to Ghai’s CRC) . That’s exactly when Khaiyum committed TREASON.

Nowadays, it seems even holding his holy book scares the shit outta him.

Nowadays Khaiyum is so lazy and uninspired a thinker that he rather STEAL someone else’s ‘intellectual property’ than bother being creative. Khaiyum shamelessly and without any qualms, STOLE the Fiji First Party name from its original owners.

Nowadays Khaiyum is simply a shameless CHOR.

And thanks to close Khaiyum aides of the saffron brigade to have revealed this HK letter of Khaiyum’s to the world.

Thanks Victor for the interesting developments. Please keep the information flowing my brother. Our country needs it. More people will hear, know and understand. With this understanding, there is a chance they will say, "ENOUGH OF THESE LIES, HYPOCRISY AND DECEIT. WE WILL STAND FOR TRUTH, RIGHTEIOUSNESS AND JUSTICE FOR ALL PEOPLE".

Khaiyum NEVER had an "excellent reputation". He did have a reputation as a decent bloke at one time but that's long gone. He is now a caricature of the very same political scoundrels he used to fight against. Power corrupts. And, Khaiyum had a taste of absolute power. That is what defines the man now.

...But to RIG an election and to steal the mandate of the people...what kind of crime is that? It is an hideous and a cowardly crime.

You are right the power has absolutely corrupted this Khaiyum falla. The other political parties too seemed totally lost as to how to react to this Dictatorship.
