THE LATE SUNDIP PATEL: The Man and the Image - A Very Personal Reflection by Russell Hunter, former editor-in-chief and CEO, Fiji Sun

History in all likelihood will not be too kind to Sundip Patel. And that’s unfortunate for while he lived up to every inch of his public persona as the ruthless businessman, he had a compassionate and caring private side.

And a wicked sense of humour.

I knew him as, at first, editor-in-chief of the Fiji Sun and later as chief executive officer. Sundip was the managing director and majority owner.

I have never denied the many claims from many sources that he interfered with editorial content and direction. But now I will.

Even when Victor Lal and I were pursuing the story of Mahendra Chaudhry’s secret overseas stash of cash – remember Chaudhry was finance minister in the Bainimarama regime at the time – he never commented, interfered or even asked for our sources. Of course he would have known we would not have given them but lesser businessmen would not have been able to stop themselves from using whatever means was at their disposal to discover them.

Sundip did not, nor did he flinch in the face of threats (never acted upon) by Chaudhry.

However, it was known to me that he was under fierce regime pressure to alter the editorial tone of the Sun which at the time leaned heavily towards an anti-Bainimarama, anti-coup line. In fact he had been told by senior regime figures that he’d get rid of me if he knew what was good for him.

Not wishing to hold the company back, (having been at least instrumental in its dramatic revival after a near-death experience) I three times offered to resign. Sundip brushed the suggestions aside.

In fact after I was illegally deported from Fiji by the regime in February 2008, I carried on as CEO of the Sun working from Australia until, a year later, he finally was swayed by the promise of government gold in return for a Fiji Sun in its present lap dog role.

It was all just money to Sundip.

He appointed a vastly more pliable person as my deputy general manager though it was clear to me what the real purpose was. I resigned and have never regretted it.

All this is well enough known. Less well known is the fact that Sundip allowed the company to spend close to $130,000 on pursuing the illegal regime for its criminal act in deporting me. But it soon became clear that even if we could win a case in the Bainimarama court, any judgement – just like the high court order prohibiting my removal  - would simply be ignored.

He was also under pressure from the Gujerati community in Fiji, who saw opportunities under Bainimarama, to come round. Eventually he did and made a lot of money in the process.

As always, perhaps, the man is more complex than the image.

He spent at least half of his life in aircraft as he expanded into Australia, PNG, India, Sri Lanka, Singapore and Samoa.

Sundip would berate me for my cigar smoking habit – and bring me back a box of Havanas from several of his many travels.

He would complain about staff – and send at least one abroad for health treatment when it was needed.

It would be an error to rush to judgment on Sundip Patel – whether that judgment be for or against.

Fijileaks Editor: The Fiji Sun had come so close to folding up (death) - Sundip Patel had lost about $6m on it before Hunter arrived - he (Sundip) was, therefore, so glad to see it in profit and didn't want to interfere with the paper's editorial content. However, the Gujerati connection was relevant to him. He used this connection to persuade Victor Lal (through a wealthy Suva Gujerati businessman relative of Lal) to return to Fiji Sun as a columnist to boost the paper's circulation. Lal wrote hundreds of columns, many highly critical of SDL policies, anti-military coup articles, and on many other topics, free of payment. But Sundip just about exclusively socialised with the Gujerati business community who would have pressurised him to do as he did with the post-Hunter Fiji Sun, for they acted as a group and risked being treated by Bainimarama as one. Fijileaks thinks Sundip was keen to see Chaudhry brought down, for he saw him as anti-business. And we are sure he was the driver of the Fiji Sun's new lapdog policy. But he had stood by Victor Lal despite death threats from
Lieutenant-Colonel Sitiveni Qiliho (now Land Force Commander) to Russell Hunter and Lal, and even the possibility of Fiji Sun being fire-bombed out of existence if the paper continued to reveal Chaudhry's tax details. He also stood firm against the legal writs slammed against Lal and Fiji Sun by FIRCA. In the end he breathed a sigh of relief and was elated when Lal's tax evidence against Chaudhry and the secret $2million revelation won Fiji Sun the Best Paper of the Year Award, with Lal and Hunter co-sharing the Robert Keith-Reid Award for Outstanding Journalism in 2008. In a cruel twist of irony, both Lal and Hunter were not able to attend Sundip's funeral in Fiji for after the Chaudhry tax story, both were declared prohibited persons from entering Bainimarama/Khaiyum's Fiji. Sundip had no restrictions placed against him, for Fiji Sun had become a pro-regime newspaper by 2009. RIP.

Dear Editor
Russel Hunter's comments on and attempt to be fair to Sundip Patel are interesting and raise many more questions about the role of the Fiji Sun after he left as publisher. May I point out however that Russel is incorrect in generalizing that "He (Sundip) was also under pressure from the Gujerati community in Fiji, who saw opportunities under Bainimarama, to come round." Most of the Gujarati community are not business persons, as the stereotypes would have it. No doubt there may have been some prominent business persons putting pressure on him, including some prominent Gujerati ones we all know about. Your comment, editor, also makes this incorrect generalization which harmfully fuels the racism in Fiji against Gujerati by some Indo-Fijians who are descended from the girmitiya. Professor Wadan Narsey

Picture
Dear Editor
I'll just this once break my rule of not responding but Wadan Narsey (one of the non-businessperson Gujeratis he refers to) does make a valid point. It doesn't, however, alter the fact that the Gujerati business community wanted the Sun to take a pro-regime line. Russell Hunter

Good Evening Acting Permanent Secretary for Education

I refer to my letter of resignation sent to you only yesterday based on your unjustified indefinite suspension without pay.  I resigned because of duress and frustrations caused to me by the Minister. The effective date of resignation is 29th January 2015 and this is procedurally correct as per GO/ HR policy of MOE "that a months notice shall be given to the employer" when there is an intention to exit.

I also know that there is a norm in the Ministry of accepting the withdrawal of resignations before the effective date of resignation.  I have watched FBC TV news this evening where the Minister Dr. Reddy  is quoted saying "that I resigned to avoid an investigation" and further the Fiji Sun reporter is quoting the Minister saying "I was investigated by PSC and I am unable to provide my reply".

Madam A/PS both the statements by the Minister are incorrect /false and misleading. I have never been investigated by PSC nor questioned by the Minister on the issue of Bhawani Dayal Arya College. I resigned because I was frustrated and under duress at the manner in which I was treated as a senior civil servant of this country. I am definite you haven't obtained any advise from the Solicitor Generals Office on this matter.  This indefinite suspension without pay given to me  is a personal vendetta of the Minister and it is illegal. The disclosures provided  with the suspension letter is compiled by Director Secondary and junior officers of the Ministry and it contains their names and signatures.  This case is 3 months old and the investigations were completed two months ago.

I also know  that the teachers who gave evidences against the Principal were transferred out on the directive of the Minister and the Principal who is his good friend is now retired. Your office needs to note that the recording of the mobile communication without my authority and putting it to circulation is an offence. It is in breach of the Communications act and your decision to suspend me and your plans to terminate me later on this illegal acts of the unbecoming teachers is a planned deliberate act to finish me off.  I am  convinced  that you are not able to provide sound advises to the Minister and you both are failing to comply with the disciplinary procedures of the government.

I have been a loyal and committed civil servant of this country providing the nation with quality education from the position of an Assistant teacher, Head of Department Commerce, Assistant Principal, Vice Principal, Principal of a small school to a very large school, Senior Education officer Secondary, Principal Education Officer Secondary, Director of Secondary Education, Deputy Secretary Primary and Secondary and then acted as the Permanent Secretary for Education for 5 months with an outstanding contribution at every level of my service. I boast with dignity having a good knowledge of the system.

The directive for suspension hasn't come from PSC but the office of the Permanent Secretary thus the message is very clear that the Minister has been instrumental in the rescindment of my acting appointment, revert me to Deputy Secretary post and then use the powers as per the constitution to finish me from the system. "Monday 22nd December 2014 in his board room he made a comment to me in the presences of the post processing unit while I was discussing with him a post of Senior Secretary advertised for his office" he said and I quote "stop flying very high"   unquote.

He had already decided to finish me and my letter of rescindment was received by the PSE office on 23rd December 2014.  A/PSE I need to clear myself from the stigma that the Minister is now casting on me after I opted not to fight but quietly and with dignity resign from the  service with a good name. My husband and I after a lengthy discussion and with deep regrets had come to an agreement to end my career as a teacher administrator. It was painful but I took it as my destiny thinking this Minister would tarnish my image and reputation. I had decided to go out with fond memories of my very healthy and successful civil service career. I am now formally withdrawing my resignation and ready to be investigated. I want truth to surface and evil to end for good.

I am also very politely and humbly requesting the Honorable Prime Minister and the Deputy Prime Minister to appoint a team to investigate the Minister for Education Dr. Reddy. I have highlighted his breaches of civil service procedures in the letters sent earlier.  The Minister Dr. Reddy is a human being like me and he is just there by peoples choice for service. He should also be sent on leave to allow for a fair and an independent investigation I understand the Ministers are politicians and their positions are ceremonial. Their  approaches to the staff  and the general public has to be friendly and diplomatic to win the hearts of people under their leadership.

Whilst the Honorable Prime Minister and the Deputy Prime Minister are according respect and dignity to women leaders, Dr. Reddy is hell bent to destroy my aspirations, self respect, my achievements, attainments and my civil service career path.

I also request that my investigation is carried out under the supervision of another Minister and independent investigators who are familiar with the civil service procedures and will not be manipulated by the Minister for Education Dr. Reddy.

I want my name cleared from this cheap plotting by the Minister Dr. Reddy as he is revenging. An independent and a transparent investigation will prove me innocent as I have always performed my duties with dignity and within the ambit of my duty statements.

MISPLACED STATEMENT: THE Opposition fails to see the string of very serious allegations against Ganesh Chand; we wonder why he was NOT booted out LONG AGO

Fijileaks is happy to have finally seen Chand SACKED; now he should be taken in for questioning by FICAC over spate of alleged wrong-doings! Even Police should be involved over alleged cover-up for his brother at the Labasa campus for alleged sexual assault against a student which was reported to Bainimarama, then self-appointed Prime Minister!
AND THIS MAN should come out of hiding and explain why he failed to act against a string of complaints to him in 2012 against Chand, and now against his side-kick and Education Minister Reddy who is still intimidating and harassing Mrs Basundra Kumar

Picture

STICKY APPOINTMENT: Ganesh Chand's cousin Kamlesh Prakash appointed a 'syrup maker' as electrical expert and when a senior staffer questioned the appointment he was SACKED, and Bainimarama turned a deaf ear for Chand (with Reddy) was writing the regime's Budgets!

Bula Mr Lal.

My name is ____________(name and job description withheld) and I was  ________when the merger with FNU took place. In my opinion the merger idea was never a good idea as it was motivated by the need for Ganesh to get his hands on the Levy funds. Anyway Ganesh appointed his first cousin Kamlesh Prakash as Director NTPC and it turned out that Kamlesh and Ganesh were birds of a feather. Please see attached email correspondence between myself, the Manager Electrical Training (Technical Experts) and Kamlesh when he appointed a training officer without following due process only to find out that the person he appointed was a syrup maker and not a trained Electrical expert. You will see that Kamlesh is as much a dictator as Ganesh. You may print the email but please keep the names out as some are still working at NTPC. I was eventually pushed out by Kamlesh because I would not allow myself to compromise my principles. I have also attached some documents relating to my case
Regards

AND just look at the injustice - Chand reportedly walking away with one and half years salary, with Opposition talking about due process on behalf of Chand! BLOODY SPEAK UP FOR SCORES OF HIS VICTIMS!

Mrs Kumar told she failed to behave in a manner acceptable to PSC and an appointed Commission will investigate allegations against her - what about allegations against Reddy?

Deputy Secretary Kelera Taloga (pictured) is the new acting Permanent Secretary for Fiji's Ministry of Education. She was appointed to the position on Christmas Eve, replacing Basundra Kumar who held the role in the lead up to this year's election. When asked to elaborate on the reasons for the change, Minister for Education Dr Mahendra Reddy referred all queries to the Public Service Commission (PSC). Comments are being sought from the PSC. Kumar was appointed to the role in an acting capacity prior to the election in place of Brij Lal, now an MP, who had resigned to contest this year's election with the Fijian Government's FijiFirst Party. Source: FijiLive, 29 December 2014

When asked why Kelera Taloga replaced Basundra Kumar as acting PS Education, Reddy referred all queries to the Public Service Commission. But Fijileaks reveals what really happened as Reddy continues to hide from Fijileaks over sexual misconduct allegations, and is also lying through his teeth that Ganesh Chand's sudden departure is not linked to FICAC investigation and that he (Reddy) is not aware what FICAC is investigating against FNU. The liar knows the truth, for from phone call records from him to FICAC reveal he was constantly interfering to suppress FICAC investigations!

RE: Resignation from Service

"Dear Sir

I wish to tender in my resignation from the service with effect from 29th January 2015. I have handed over the office of the Permanent Secretary of Education today at 2pm to Mrs. Kelera Talonga the Deputy Secretary Professional as per the letter from PSC dated 23rd December 2014.

I am being compelled to resign because of the following reasons (Fijileaks in bold):

1. Immediately after my handing over, I was issued with a suspension letter without pay effective from 30th December 2014. This is a clear indication of a personal vendetta against me. The suspension is issued based on a case at Bhawani Dayal Arya College in early October 2014. At this particular school the Principal was exercising lethargy and the Mathematics department teachers were having a free ride. I merely executed my duty as the Permanent Secretary of Education.

2. The Minister took over the case in his hands and entertained a recorded CD made on me which is baseless and contains no merit for a suspension without pay. There were obvious frustrations raised by teachers at the school about the conduct of business in the school. The Ministers wife was also teaching at the school and implicated. Those teachers who gave evidences against the wrong doings were immediately transferred out of the school upon the instructions by the Minister himself. A serious crime was committed by the Principal and evidences were clear but the Minister concealed the crime and has aided and abetted the Principal. I sent him a message through Director Secondary that the case needed to be reported to the Police but my advise was ignored.

3. The Minister failed to report the case then to PSC, if he had thought I had breached the code of conduct. Instead he quietly without A/PS’S (my knowledge) directed the Director Secondary to form a task team, investigate and report to him so that he could save his wife’s and his reputation. He is a micro-manager and performs the duties of the PS interpreting the constitution to his pleasure.

4. The Minister has no respect for the staff; he is an uncouth person, breaching the Civil service procedures, practicing parochialism, cronyism and favoritism.

5.  He (Minister) works against the civil service procedures and when advised correctly feels offended, shows tantrums and threatens all for suspension and termination. He has a disregard for cabinet collective decision and unilateral decision making.

6.  I continued to protect my staff against his vindictive approaches and he felt I was not supporting him thus he began plotting against me so that I could be removed from the position. My staff have been looking to me for rescue but I was always helpless. I have now made up my mind that I will not be able to work with this Minister.

I am attaching a letter of complaint written earlier together with my resignation letter herein for my employer to note and understand the duress compelling me to resign from the service. I thank the Ministry of Education for recognizing my good work and the positive contributions that I have made to the education sector in this country.

Fijileaks Editor: After the FNU Council met and sacked Dr Ganesh Chand as Vice-Chancellor, partly in response to a spate of highly damaging stories against FNU in Fijileaks, a PRESS STATEMENT was immediately prepared by Education Minister Dr Mahendra Reddy's acting Permanent Secretary for release. Within minutes, Fijileaks was informed that Reddy instructed his permanent secretary not to issue the statement, for it would give credence to Fijileaks sacking story. Worst, Reddy demoted the acting PS to Deputy PS. More on Reddy coming soon!

RE: Person of the Year Article (27/12/14) FIJISUN

I write to make a complaint on an article by Jyoti Phatibha in the FijiSun newspaper on the 27 December 2014 under the title Person of the Year.

I am most concerned with Ms Pratibha's decision to attack SODELPA, carrying inaccuracies into the hands of the papers readers. In claiming the Party was resoundingly defeated at the polls, that the party played the divisive race card and whilst falling short of campaigning for Fiji First, that SODELPA's policy's were in no way a contrast to Bainimarama's platform for delivering Economic, Security, Equality and Service to the people of Fiji.

This is a abuse of the newspapers privileges and a clear sign that people like Pratibha can-not be trusted to write neutral, factual and non personal articles, which are journalistic principles I thought guided your newspaper.

Where is the Proof that SODELPA played divisive racial politics in the lead up to the September 2014 General Elections? Where is the proof that SODELPA was canceled out in the national vote or resoundingly defeated and are not represented in Parliament?. Where is the proof that SODELPA via their manifesto and historic democratic governance since 2001 as SDL could not provide a platform for delivering Economic, Security, Equality and Service to the people of Fiji?
Fiji Sun has deliberately produced an article that is not factual and littered with one persons controversial ideas presented as attribution.

I personally think that the Fiji Sun, is fast bordering on embarrassment to Fiji's mainstream media and Ms Pratibha's lack of practice of Journalistic Ethics is a concern, and it seems very likely that Ms Pratibha and the Fiji Sun are seeking to distort facts, create animosity and rekindle racial slurs with it's constant hate reporting on anything political other then FIJI FIRST or Frank Bainimarama.

On the 23rd September 2014, I wrote to the Media Industry Development Authority and the Fiji Sun to complain about an article written by Ms Pratibha about me; where she demanded that I as the SODELPA Youth President should be 'cleaned out' of the Party. She also declared to the Nation that I should Shave and buy myself a deodorant. Since then, no retraction or apology has been issued.

Ms Pratibha also complained to The International Federation of Journalists regarding a story she had fabricated involving my Facebook posts - on the 10/09/14, the Federation reported that Ms Pratibha received threats and was a target of an assault after I posted a comment about her on my Facebook page. I hope Ms Pratibha has evidence that I have written so passionately about her (like she has about me) because uptill now, I have tried not to comment on her unprofessional journalistic skills. I also cannot can-not be blamed for all the racist comments and feelings generated by her articles and hate reporting. These are the fruits of the newspapers inaction over hate reporting and the distortion of the true feelings of indigenous people and our leaders.

As a citizen of Fiji, and a reader of the Fiji Sun, I demand change in the Newspaper's reporting immediately.

I also demand that Ms Pratibha is disciplined for her racist, biased and hate reporting.

I also demand that Fiji Sun perform a background check on the facts calling SODELPA a racist Party; and immediately accept that Indigenous Rights is Human Rights, and the rights of Fiji's Indigenous population to self determination and safeguarding under International Human Rights Standards is not Racist but an exercise of our responsibilities as Indigenous People.

Where is Media Freedom when parcels of the Media act irresponsibly and act to promote one party rather then present a unbiased and factual approach to it's reporting

Mr Raj

I thank you for your swift response, I also ask, why are you waiting for FijiSun to respond? Does MIDA not have the resources or the time to investigate these serious claims immediately and make a suitable discernment on the matter

I draw your attention to a complaint made to MIDA on the airing of an advice to Frank Bainimarama by a member of the Tailevu Provincial Council in April 2014. In a statement to Fiji Citizens, you said “Masquerading itself as an exercise in freedom of expression, political discourse has, in fact, descended to unabashed racial vilification and in some instances its content is tantamount to injurious or hate speech,” and in part without Fiji TV's official response did you not pass judgment.

Did MIDA wait for the official response of Radio New Zealand and Al Jazeera before claiming the organisations were guilty of biased, unbalanced and inaccurate reporting.

The reason why I think, seeking Fiji Sun's official response is nonsensical, is captured in my initial complaint. Since the 23rd September 2014, I have yet to receive a official response from Fiji Sun and thus you have yet to 'adjudicate' on that matter.

Mr Raj, I ask that you urgently look into this matter as Fiji Sun seems to be running wild on fabricating news and creating much racial tensions by attacking Indigenous Rights, Leaders and Consciousness
Mr Raj, I repost my demands herein

As a citizen of Fiji, and a reader of the Fiji Sun, I demand change in the Newspaper's reporting immediately.
I also demand that Ms Pratibha is disciplined for her racist, biased and hate reporting.
I also demand that Fiji Sun perform a background check on the facts calling SODELPA a racist Party; and immediately accept that Indigenous Rights is Human Rights, and the rights of Fiji's Indigenous population to self determination and safeguarding under International Human Rights Standards is not Racist but an exercise of our responsibilities as Indigenous People.

HONOUR BLEMISHED!: Parent of student allegedly sexually assaulted by Vice-Chancellor's relative on Labasa Campus willing to waive anonymity to Fijileaks; says the staff reported the sexual abuse to Bainimarama in 2012 but the dictator and his side-kick Khaiyum did nothing, nor Mahendra Reddy; instead they were kept as 'Budget Writers', with Reddy getting FijiFirst Party ticket by Khaiyum to fight election! FICAC, the parent says, is a persecuting organization to harass opponents

Fijileaks to Dr Mahendra Reddy: RESIGN before we reveal your 'kama sutra escapades' and highly comprising e-mails between you, regime, and your cronies! Pro-regime FIJIAN JOURNALISM will no longer protect you! Sadly, 36 FNU Property Workers were crying out for help from the wrong person - Vice Chancellor Dr Ganesh Chand!
