BOOTED OUT OF UAE: Suspected Desert Hacking Fox counselor Aliki Salusalu and Robin Nair's First Secretary Emosi Rakai both soon to be without jobs following their dismissals from their UAE embassy roles!

ALIKI SALUSALU - the suspected  'Desert Hacking Fox' - has been recalled to Fiji immediately for all the years of alleged subversive activities and the undermining he had been involved in against  Frank Bainimarama, Aiyaz Khaiyum and most viciously against his Ambassador Robin Nair, with dissidents groups in the UAE and in the Fijian Foreign Ministry.

The Fijian Foreign Ministry had been aware of these activities but procrastinated in taking appropriate and timely action. It is believed that Bainimarama had to intervene personally to demand action. Salusalu's co-conspirator, First Secretary Emosi Rakai, was sent off on leave and has been denied any extension of contract. It is believed both of them will not be returning to the Fijian Foreign Ministry.  Rakai was also accused of speaking to the IRB during the Dubai Sevens and the Fiji One saga, reporting to IRB, on behalf of his Fiji One brother-in-law. He was also accused of reporting from  Dubai on the visit and the presence of Bainimarama at the Dubai Sevens. Fijileaks: More  to follow.

SODELPA: LAND OWNERSHIP NOT FOR POLITICAL GRANDSTANDING

30/7/2015

Picture
The issue of land ownership is a matter that should not be used for political grandstanding, and both Government and the Opposition need to be sensitive to the people of Fiji especially to the Indigenous Fijians on the matter of land.

The President of Sodelpa, Turaga na Tui Cakau Ratu Naiqama Lalabalavu in responding to the allegation by the Honorable Prime Minister yesterday that Sodelpa continues to lie to the Indigenous people of Fiji that their land was not safe, stated that Sodelpa was not interested in political debate over land, and instead called on both Government and the Opposition to be sensitive to the indigenous owners of land and not to confuse them or draw them away from the truth.

Instead, the Party,  Ratu Naiqama said, wanted resolutions and the review of some of the policies that encroach on land matters as well as other indigenous owned resources for example the Land Use Decree, the Regulation of Surfing Areas Decree and the Mahogany Industry Development Decree.

“Sodelpa has always maintained its position that some of the aspects of the mentioned Decrees are not conducive to the true spirit of mutual benefit and enterpreurship. It defeats the normal process of justice for example, the clauses within these Decrees that disallows any attempt by any aggrieved landowner to pursue redress in a Court of Law should they be dissatisfied with any aspect of the use of their resources by the tenant or the governing authorities.

That is the reason why Sodelpa has maintained that the land is neither safe nor secure, under such draconian regulations. We are not interested in lying to the people. It serves us no purpose,” Ratu Naiqama said.

He also further pointed out that land issues must not be grandstanded and said that Sodelpa would instead be keen to dialogue with Government on matters pertaining to land matters that affect our people.

“We must find a common ground for our people and for the nation. In this case, Sodelpa is appreciative to note that some of the land and resource utilization policies that it fought for during the election campaigns were now being implemented and recognized by Government as having merit.

He pointed out the new laws that now require the processing of all Bauxite minerals locally for example, other than having soil carted off to China as was being done in the last couple of years.

“This is progressive and we are appreciative that Government seems to be considering some of the issues Sodelpa is raising in the interest of our people. Whilst we encourage and support investment initiatives, we must however not do so at the expense of our people and our economy, and what we could derive from the proper utilization and maximization of our resources,” Ratu Naiqama concluded.

"I believe development is for everyone. The FijiFirst Government doesn’t discriminate. We don’t pander to vested interests or the elite. We look for areas of need wherever they may be in Fiji and make them the priority. We put our tax dollars where they are needed most. Development based not on who you know or who you voted for but on genuine need." - Frank Bainimarama
Fijileaks
to Bainimarama: How about Shirley Park and Churchill Park being parceled out to elite businessmen?

PM: We’re Reversing Neglect Of Past Governments

Prime Minister Voreqe Bainimarama says his FijiFirst Government is steadily reversing the neglect of past governments.

“And their failure to properly develop our nation in the four decades since Independence. Wherever you look, we are getting things done,” he said.

He was speaking at the opening of the final stage of the Buca Bay Road in Cakaudrove yesterday. It cost more than $73 million. The first stage cost more than $40 million.

“Our political opponents, of course, continue to spread the lie that we are actually doing little or nothing at all.

“They are blind to everything around them because they need to cover up a basic fact,” he said.

“That when they had the chance to govern, they did little or nothing except for themselves and their supporters. The rest of the nation was left to fend for itself.

“Unlike them, I believe development is for everyone. The FijiFirst Government doesn’t discriminate. We don’t pander to vested interests or the elite. We look for areas of need wherever they may be in Fiji and make them the priority. We put our tax dollars where they are needed most.

“Development based not on who you know or who you voted for but on genuine need.

“One of the biggest lies that SODELPA continues to spread is that we are eroding the rights of the iTaukei when the reverse is true. We have strengthened those rights and ensured that they are protected for all time.

“And I urge every iTaukei to examine the truth for yourself by reading our Constitution that we had translated into iTaukei.

“Not a single inch of iTaukei land has been lost under my Government prior to the election, under the Constitution or under the FijiFirst Government.

“In fact, it is because of this Constitution and my Government that the iTaukei today are more empowered than ever before. And their land is more secure than ever before.

“Always remember that many of these liars were among those who brought the country to its knees in 2000. They have nothing else to offer but more of the same. More fear. More suspicion. More hatred.

“A nation stuck in the past and turning in on itself rather than a nation that is united and outward looking – searching for better opportunities for everyone.

“I have a fundamentally different view of the Fijian people than they do. They think ordinary Fijians are stupid and can be manipulated into supporting them with their pathetic scare campaigns. Whereas I preside over a Government – the FijiFirst Government – that respects the intelligence of the Fijian people and values their common sense.”

Fiji to be assessed on anti-money laundering compliance

Fiji will be assessed on how well it is complying with the international anti-money laundering standards in October.

Some things Fiji will be assessed on include anti-money laundering laws, policies, coordination, powers of the law enforcement authorities, preventative measures for bank and other financial institutions, convictions and confiscation of proceeds of crime.

Financial Intelligence Unit Director Razim Buksh says the mutual evaluation will be very intensive and will see the involvement of both the public and private sector agencies.

HON. A.T. VADEI.- I am surprised that there is no I Taukei to be a board member of the USP. There used to be I Taukei who are successful in the field of accounting, economics, et cetera, to be there. What really happened to that?

MR. K. BOILA.- Mr. Chairman, I will not be able to respond to that question. There are various factors that would contribute, so I cannot comment on that.

The Assistant Minister Bhatnagar should be sent back into the classroom for wasting the Committee's time by asking ill-prepared question:

HON. V. BHATNAGAR.- As you mentioned TELS, if you can give a little clarification as to how this works. As far as I know, once students go into TELS, they do not pay back. Is there a timeframe for how long and suppose a person is unemployed for one year or two years, are they required to pay back or the guarantor required to pay back?

DR. R. WAH.- The TELS does not come under the Commission, so I cannot answer that.

The Manager

cc: Prime Minister of Republic of Fiji Islands, Commissioner Western, Fiji Independent Commission Against Corruption, Chief Registrar's Office, Fiji Police Force, FMF

Good Morning,

My name is Daya Nand and I am about 80 yrs old. I am writing this letter to inform the authorities concerned about how I have been made to leave behind my home which I build through years of my hard-work being a sugar cane farmer in Varavu sector of Bilolo, Ba. My father was a Mr. Devi Prasad of Bilolo, Ba. He gave me about one acre of land back in days. In his last will (Copy of the will is attached) he mentioned that also. When he passed away, that same will was used in getting the probate.

On the 1 acre of land, I built a wooden house with 5 rooms and a kitchen ( Plan of the property is attached). The 1 acre on which my house was built was part of bigger property (Native Lease) which had houses of my brother Mr. Birendra Prasad, Mr. Sajla Nand and Mr. Shankra Nand.

Mr. Birendra Prasad was a trustee of the entire property and an agreement was made whereby I would pay the rent of 1 acre to him on yearly basis and I did that for years. When Mr. Birendra Prasad got sick, he made power of attorney in the name of his youngest son, Mr. Videsh Kumar of Bilolo, Ba.

In 2012, Mr. Videsh Kumar surrendered the native lease on the property even though the older lease still had couple of years left for expiry. When the lease was surrendered in 2012, I was unaware of it. I was under impression that we still have couple of years left for lease to expire.

In the midst, my son Mr. Kamlesh Chand Vinod knew about the surrender and without informing me he applied for the residential lease through iTaukei  Land Trust Board on 08-0ctober, 2012 ( Receipt is attached).

On February 18, 2013, iTaukei Land Trust Board sent Mr. Kamlesh Chand Vinod a letter stating the he was approved a lease at cost of $4040.00 with a rent of $200.00 per month (Letter is attached). Mr. Kamlesh Chand Vinod paid $4040.00 to iTaukei Land Trust Board and got the property on which my house was located under his name. When I found out about this I asked him that whatever he did was wrong and he needs to transfer the property to me since I was the one who owned it before and I built the house through my hard-work. He disagreed and kept the property on his name.

Meanwhile, Mr. Kamlesh Chand Vinod and my relationship detoriated over time because of my second wife. Mr. Kamlesh Chand Vinod hated my wife hence there used to be lot of arguments and the matter even went to police and court. He made living in that house a nightmare for us. Eventually being fed of all arguments and police case, I and my wife had to leave that house.

My daughters made arrangement for us to stay in Moto, Ba. We are totally dependent on daughters for financial support in paying the rent and day to day expenses and also some support from welfare. I don’t know how much longer will my daughters help me financially since they have their own family to support.

I am so worried about my future. I would urge relevant authorities to investigate into this matter and see why iTaukie Land Trust Board failed to inform me that the lease for the property on which my house was surrendered and I would need to apply for new lease.

I would also urge authorities to investigate and see is it fair for a son to kick out his father and step mom out of the house when his father had built the house for his dark days. How can he get a new lease on a property on which he never built anything?   Is this how things are done on Fiji in modern age, whereby iTaukei Land Trust Board has powers to approve a lease to a person who has no right to the property and that person kicks out his father and step mom.

I would like the relevant authorities to investigate into this matter and take appropriate action. I have been treated unfairly by Itaukei Land Trust Board and by Mr. Kamlesh Chand Vinod of Bilolo, Ba.   I would urge authorities to go to Bilolo, Ba and ask villagers who built that blue house in which  Mr. Kamlesh Chand Vinod lives in now and is it fair? Is this how elders are treated in this country?

Thank You, Mr. Daya Nand

Dirty secrets from under the bed sheet: As Maika Bolatiki 'entertains' his readers via 'Coconut Wireless' about the sexual escapades between a politician and a doctor, what about "Dr Jiko Luveni - the 'home-breaker'?

27/7/2015

Picture
Dear Fijileaks Editor:

"This is community knowledge about Jiko Luveni and because of conflict of interest she should have removed herself from the decision-making process that resulted in the suspension of Ratu Naigama Lalabalavu, Tui Cakau and Provincial leader of the Tovata Province, Fiji. His knowledge and comment was made under the following context and circumstances.

This truth is well known by the Community in the Tovata Province and the painful memories cannot be erased from the families, in one generation, who had to care for the six children caused by Jiko the “homebreaker. For Parliament to make the harsh judgment to suspend Ratu Naiqama Lalabalavu for 2 years because the Speaker Jiko and the Attorney General Aiyaz Sayed Khyum did not declare conflict of Interest is justice denied to the children involved in her “home breaker” history.

Going back historically, the Luveni’s moved to 17 Hamilton Beattie, Domain Suva in 1982. Yasa and Jiko lived opposite with their 4 children – whose ages ranged from 4 – 16 yrs. The Luveni’s and Yasa had  lived together and ate together because Luveni’s former wife and Jiko were close friends.

At the time, Inoke who was Commanding Officer of the Naval Base, was a Chief Engineer and was Bainimarama’s senior. In 1982, Inoke and his former wife had 2 children daughter 11yrs and son, 7 yrs. The relationship between Inoke and Jiko started when they would go golfing in the weekends leaving former the wife and Yasa to take the children to church on Sundays.

At this time there was plenty of gossip and suspicion, but Inoke always denied any allegation when asked. When Luveni’s former wife asked Jiko her answer was I am his Aunt and any sexual relationship is “tabu”.  Both Inoke and Jiko denied to their respective families any culturally inappropriate behavior and their families believed them.

It was at the South Pacific Games in Noumea, Grande Terre Island, New Caledonia 1987, when the Rakai family of Luveni’s former wife said their denial was a public joke. The ________ “put it on the table” and informed Yasa who was in Sinai.

The Luveni’s divorced in the Domestic Court in January 1989 when his former wife was asked if she agreed to divorce Inoke? As a Christian she did not believe in adultery and so gave her consent. The conditions were her share of the house would go to their son, and Inoke provided maintenance for his children. His former wife refused to take maintenance from him as she knew “he had no money to spare” for her. Inoke’s mother would not have anything to do with Jiko when she caused two family breaking up, where the children, Inoke’s former wife and grandma, painfully felt the “home breaker” impact. Grandma felt for the children and Luveni’s former wife.

In the Officer’s Mess Jiko was often heard to cruelly say in public “Yasa I don’t like you because you are old!”...In 1987, after _________ informed Yasa in Sinai, of the affair between Luveni & Tiko, Yasa returned to Fiji, immediately looked for Jiko, found her attending a Dentist’s Conference and they ended up in the Police Station. Jiko and her “home breaker” ways psychologically impacted Yasa. But he got over it.

In 1989 Luveni and his former wife’s 16 -yr -old daughter was still grieving the loss of her father and said “I don’t want to see my father with another woman”. Luveni’s teenage daughter had no closure provided by him and his new wife who was perceived, especially by the Tovata community. as the cruel “home breaker”.

This explains Ratu Naiqama Lalabalavu’s comment “cavuka” meaning Jiko had broken/lost her mind when her actions resulted in leaving her 4 children and Inoke his 2, for what??? Sex??? Community information cannot be denied in natural justice - only in a dictatorship Parliament, it seems.

Yasa asked Luveni’s former wife “Tau do you want your husband back again?” But she declined the offer, gracefully and said she now enjoyed her freedom and her Christian peace, often visiting her children, who take good care of her. Yasa sort political asylum in NZ with all his 4 children and is now happily married. Hopefully his happiness will bring them peace. Today Luveni’s daughter is happily married in Sydney but the wound of losing her father has left an “unresolved pain”.

Fijileaks:
We are yet to get a comment from Jiko Luveni.

The news about the sexual liaison between a politician and a hospital doctor plus another politician and an old flame is not going away soon.
Questions about politicians’ conduct are getting louder and louder.
Whether they are blinded by the romance or not, the bold way they have been carrying on is now a matter of grave concern among party members.
Party talanoa sessions around the kava bowl are now dominated by discussions about the various sexual encounters involving the party’s politicians.
Is it something to do with being in Parliament? The prestige, honour and respect being misused?
Does life really start after Parliament?
You’ve heard of Mid-Life crisis? Is there such a thing called Mid-Parliament Crisis?
Mickey Bird has been bombarded with these questions from many people who have followed with interests the politicians’ sexual encounters.

Repent and forgive
Many religious members of the party put on their best attire today to go to church.
It’s one day of the week they feel spiritual and want to be close to God.
It will be especially good for those politicians caught for their recent sexual indiscretions.
If they are truly repentant, they can be forgiven.

Public awareness
Party members are grateful to Coconut Wireless for raising public awareness about politicians’ secret sexual indiscretion.
A third politician was on the brink of jumping on the bandwagon but stopped when their cover was blown.
Big brother is watching, says Mickey Bird.

'Mickey Bird' aka Maika Bolatiki: 'The BIG BROTHER' is still WATCHING

Justice Bain, Fiji High Court, while upholding Fiji Sun Managing Editor/News Maika Bolatiki (Mickey Bird's) conviction, 3 September 1997:

"The complainant was a 14 year old school girl at the time of the incident. She was one of 18 students in a classroom sitting an examination [at Bucalevu School]. The appellant [Maika Bolatiki] was supervising the examination. The complainant was sitting at a desk in the front row. She said that the appellant came and stood beside her on her left. She looked up and the appellant touched her breast with his left hand. She sat up and the accused slid his left hand down her stomach and right to her private part. He then rubbed her private part. He denied touching her breast or private parts. However, the actions of the appellant as described by the complainant in her evidence were something that would not necessarily have created attention. The other pupils in the room were writing their examination papers. The Appellant was standing alongside the complainant in the front row and such conduct would be expected to have been done as surreptitiously as possible...The learned Magistrate made a clear finding that he accepted the evidence of the complainant as truthful. An appellant Court would need very compelling and cogent reasons to interfere with that finding. There are no grounds to do so in this case...The appeal against conviction is dismissed" - Justice Pain, Fiji High Court, 3 September 1997

Fijileaks Editor: We wrote to Bolatiki for comments in May 2014. We are still waiting for a comment from him. The judgment can be accessed at: http://www.paclii.org/cgi-bin/sinodisp/fj/cases/FJHC/1997/124.html?stem=&synonyms=&query=bolatiki

"The appellant [Bolatiki], a school teacher was charged on two counts of indecent assault on two separate pupils on two separate days. Following a defended hearing, the learned Magistrate found the accused not guilty on count 1 and guilty on count 2. Laisani, a school friend of the complainant also gave evidence. She met the complainant after the examination. She said [p.27 of the record]: "I knew something was wrong. Her eyes were puffy red. She told me she wanted to vomit. I asked her what happened. She was crying. She didn’t mention the name. She said the exam supervisor fiddle[d] around with her breast and was rubbing his hand on her private parts. This was done during the exam."

Fiji Airways pays Fijian Government first dividend in seven years Nation Benefits from Airline’s Record Operating Profits

Thursday 23 July 2015:

Fiji Airways has paid its major shareholder, the Fijian Government, a dividend of more than FJD $2.5m following its record profit of $60.8m last year.

A cheque for the amount was formally handed over today to the Attorney General and Minister for Aviation, the Hon Aiyaz Sayed-Khaiyum, by the Chairman of Fiji Airways, Nalin Patel.

The dividend allocation to the Fijian Government – which owns 51 per cent of the airline - is part of an overall payment of just under FJD $5 million. ( FJD $4,957,576.33 )

The rest is shared with the other major shareholder, Qantas - which holds a 46 per stake in Fiji Airways – plus the other shareholders – Air New Zealand and the Governments of Kiribati, Tonga, Samoa and Nauru. Fiji receives a total payment of FJD $2,528,344.25, Qantas receives FJD $2,296,118.08 and the others receive amounts depending on their respective stakes.

Last year’s operating profit by Air Pacific Limited, trading as the Fiji Airways Group, was more than double that of the previous best result in 2005 and today’s dividend payout is the first since 2008.

It represents a return on the earnings of Fiji Airways and its subsidiaries Fiji Link and Pacific Call Comm Ltd plus the Group’s 38.75 per cent stake in Richmond Limited, owners of the Sofitel Fiji Resort and Spa on Denarau Island.

Mr Patel said Fiji Airways was delighted to be now in a position to share its financial success by giving a return to its shareholders as well as rewarding its staff through its pioneering profit-sharing scheme announced in February.

“Since rebranding to Fiji Airways from Air Pacific in 2013, the airline has achieved significant success thanks to the hard work of our entire team. Alongside our dividend distribution today, 835 eligible non-management staff have also received a profit sharing payout of $3000 each. And all eligible Fiji Airways and Fiji Link managers received a management bonus of $7,000 each, subject to tax and superannuation deductions as required”, he said.

In accepting the dividend cheque, the Attorney General also paid tribute to the staff of Fiji Airways for what he termed their great contribution to the airline’s financial performance.

“ On behalf of the nation, I want to thank every worker at Fiji Airways for showing every Fijian what is possible when employees work constructively with their managers as a team. An airline that many had written off is now flying high again thanks largely to your efforts. And every Fijian is benefitting not only from the dividend cheque we are receiving on their behalf today but in the great pride we all feel in Fiji Airways. With your continuing efforts, we are well on the way to fulfilling our ambition to build a world class boutique airline and take the Fiji Airways brand to more destinations”, he said.

The Acting CEO of Fiji Airways, David Bowden, said the national airline had been turned around with the adoption of a clear and strategic five-year plan that commenced in December 2013.

“ Our financial performance provides us with the foundation to continue to build the business over the remainder of the five year plan, but there’s no room for complacency. We must continue to make long-term financial decisions that are sustainable and in the best interests of the airline. On this basis, we look forward to sharing more of our success with our staff and shareholders at the conclusion of the current 2015 financial year”, he said. Source: Fiji Airways Press Office

Victor Lal and Russell Hunter (September 2012) to DPP and Fiji Police: "6. We request the Director of Public Prosecutions to establish whether Mr Chaudhry and Nalin Patel, in presenting to FIRCA the letter from Harbhjan Lal, whose content was materially false [re his enquiring the details of the funds etc] –Chaudhry (and Nalin Patel) committed a criminal offence under Fiji’s tax laws by offering a false document to FIRCA, namely the Harbhajan Lal letter."

On 20 August 2012 Victor Lal wrote to Nalin Patel asking the following questions:

Dear Nalin

Bula.

Did You/Pradeep read the contents of Harbhajan Lal's letter dated 9 September 2004, which is in direct contrast to the evidence you were presenting to FIRCA on his [Mr Chaudhry’s] behalf?

When was the first time you came into possession of Harbhajan Lal's letter?

From all the correspondence to FIRCA there are so many inconsistencies - the letter was written on 9 September and you chaps were still asking for extension on the 15 September.

Please note that I am not blaming you for anything but I need to ascertain certain facts

Warm regards
Victor Lal

Three days earlier, on 17 August 2012, Victor Lal had written to Nalin Patel:

Bula Nalin

You may recall I contacted you regarding Mahendra Chaudhry's tax details. You neither acknowledged nor replied to my set of questions that I had sent you in 2008.

To date, I have not been able to locate Harbhajan Lal in Haryana, and now Justice Goundar's judgment quotes a letter from Delhi Study Group, which was never a part of your exchanges, on behalf Mr Chaudhry, with FIRCA in 2004.

I would be very grateful if you could comment on the attachment, especially with the Prime Minister calling upon accountants to take a more active role in the Constitution making in Fiji.

When did you submit that Harbhajan Lal letter dated 9 September 2004 to FIRCA that year?

Did you have a copy of the Delhi Study Group letter dated 12 October 2004 also but chose to submit the Harbhajan Lal one?

Look forward to hearing from you.

Warm regards

Bala's lawyer Shalend Krishna wanted the case to be heard in 2016. All State cases are given to his law firm of Krishna & Co. All lawyers barred from practice by the Independent Legal Services Commission have to hand over their practice and client files to  Krishna & Co where Ashneel Sudhakar (Chairman, Standing Committee on Justice, Law and Human Rights) and who describes himself as 'Fiji ke mashoor gunda Gulam Dastgir'- is Barrister & Solicitor:
