Fijileaks, which had taken up the Gokals' case, found that RENEE LAL was [and reportedly still is] allowed to ply her trade because the watchdog Legal Practitioners Unit was too slow to act on the Gokals and Fijileaks combined evidence given to LPU; the matter was called on 16 November before the Independent Legal Services Commission (ILSC) and the case has now been adjourned to 27 January 2016 for mention.

* The Investigation Committee has reportedly concluded that the opening of the SODELPA OPPOSITION account at ANZ by Ro Kepa, Ratu Isoa Tikoca, Salote Radrodro and Mick Beddoes was not authorised by the Party nor did the Management Board resolved that it be used for staffing.

* The action by the four has been reportedly labelled very serious by the investigators.

* The Investigation Committee has reportedly resolved that in accordance with the Political Parties (Registration, Funding, Conduct and Disclosures) Decree 4 of 2013 section 21(1)(c) the $225,000 was a grant from a lawful source and under section 17 of the same decree the party has to account for the grant in its 2014 - 2015 audited report.

* Because it was not deposited in the official party account than the party cannot account it.

*The party, Fijileaks understands, will be answerable to the Registrar under section 18 of the decree and the party could be de-registered under section 19 of the same decree if it fails in its duty under section 18.

* The "Four" allegedly acted without the knowledge and consent of the party and now the party will have to account for the $225,000 in its audited report that shall be submitted to the Registrar for Elections.

* The Management Board of the party did not receive the grant nor did it use it, the question is how will the party show in its audit report that it used the grant?

Fijileaks could not obtain a comment from the SODELPA headquarters.

With less than a week to go before applications close for the position of CEO of the Fiji Rugby Union, the immensely popular Fiji 7s coach Ben Ryan has given a devastating interview that clearly suggests the FRU board, the make-up of the board and its conduct had made Radrodro Tabualevu’s position intolerable.
 
‘When you go through so many CEOs as the FRU has done in the past however many years, it’s not normally the CEO that is the problem,’ said Ryan, who coached Fiji to the HSBC 7s Series title this year.
 
Ryan’s intervention – couched in the most diplomatic language - suggests just how damaging Tabualevu’s departure is likely to be. Tabualevu had acted as a buffer between the coaching staff – and the wildly irresponsible and meddlesome FRU board that has been under the personal control of Frank Bainimarama since 2011. Since Tabualevu’s departure, Ryan has lost his trusted team manager, former Fiji prop forward Paula Biutanaseva.
 
Bainimarama took control of the FRU almost six years ago by threatening to withhold government funding for the New Zealand-hosted Rugby World Cup unless the elected board resigned, which they did. Since then Rugby House has had five CEOs in less than five years – Keni Dakuidreketi (resigned June 2011), Pio Bosco Tikoisuva (acting), Manasa Baravilala (sacked September 2013), Dr Berlin Kafoa (acting) and Tabualevu (resigned November 2015). An attempt by the board to appoint former magazine publisher Jeremy Duxbury as CEO in late 2013 was vetoed by the Prime Minister’s Office despite full board approval.

Minister for Education Dr Mahendra Reddy says it is not right that another politician speaks first before the Chief Guest delivers his speech.

Reddy’s comments follow a letter written by NFP Leader Biman Prasad saying that Dr Mahendra Reddy demanded that Prasad be removed from the program of the Tamavua Primary School prize giving ceremony and the opening of the new school hall today.

Dr Reddy was invited to speak as the Chief Guest while Prasad a patron of the school was also invited to speak at the event.

The Education Minister says he did not demand for the removal of Biman Prasad but just that it was not right for Prasad to speak first.

Biman Prasad who wrote to Dr Mahendra Reddy says he was supposed to speak as a Patron and talk about Jagindar Singh and his contribution to the school.

He says the programme was made several days before and he is sure that Dr Reddy knew about the program.
Prasad claims that he was told this morning that Dr Mahendra Reddy demanded that he be removed from the programme and not be allowed to speak.

He also claims that Dr Reddy demanded that if he was present, the Education Minister will not officiate as Chief Guest. Prasad says as a mark of respect for Jagindar Singh he decided to remove himself from the programme and returned to the office.

He says he found such petty‑mindedness from Dr Reddy unbecoming of an Education Minister. He says today was a happy occasion for the school and it was not about politics but Dr Reddy made it so and it is regrettable.

According to Biman Prasad two days ago, he shared the same platform with Minister Parveen Bala at the opening of the Westfield Villas in Nadi and they had a great opening.

Economists warned Chaudhry: Coup will hurt Indo-Fijians

As the military tightened its noose around the Laisenia Qarase’s multi-party government with threats to depose it, two of the country’s leading Indo-Fijian economists, Professor Biman Prasad and Dr Mahendra Reddy, wrote to the Fiji Labour Party leader Mahendra Chaudhry on 26 November 2006, calling upon him to recommend the formation of a government of national unity to avert a military coup.

The economists were writing to Mr Chaudhry not only as concerned citizens but also as members of the Indo-Fijian community, and the fact that Mr Chaudhry had the mandate of the majority of their respective community. Uppermost in the minds of the two economists was the spectre of violence against the Indo-Fijians, and Mr Chaudhry’s alleged “conspicuous silence on the role of the military”.

They recalled the violence that emanated from the 2000 coup and did not rule of new outbreak of violence in the event of a coup: “Any intervention by the military could start widespread violence against the Indians throughout the country and this may be hard for the army to control. There is evidence of this happening in 2000.” As members of the Indo-Fijian community the two of them told Mr Chaudhry that “the Indians could be the targets of all sorts of violence and discrimination”.

Professor Prasad and Dr Reddy also feared that the military might abrogate the 1997 Constitution and there was also a possibility of the re-introduction of a more racially based constitution as the 1990 Constitution following the Rabuka coups of 1987. The AG as the State’s Chief Legal Advisor should know that Parliament is not a drama theatre. It is the highest court of the land. Mimicry, drama and theatrics are best suited for a drama and arts platform as Mr Sayed-Khaiyum is only too aware and not the floor of Parliament. I challenge Aiyaz Sayed-Khaiyum to prove that my voice and character are similar to that of Darth Vader. SODELPA Opposition Whip, Ratu Isoa Tikoca today demanded that Aiyaz Sayed-Khjaiyum must step down as a Member of Parliament following unbecoming acts tantamount to racial taunts in Parliament in his capacity as the Chief Legal Advisor to Government and Acting Prime Minister. 

The Attorney General has ridiculed Government’s so-called mantra of “We are all Fijians”. His suitability to be an elected representative of the people and to act as PM has been put to shame. 

The Attorney General and Minister for Finance is sinking deeper into the quagmire with the flimsy and defenceless explanation of his mimicry and monkey-pose in Parliament on Wednesday 18th November. This was a racial slur against me and by implication the indigenous Fijian community for which I am also an elected representative of. It is particularly heinous as the disgusting stunt was a rejoinder to his comment that "Parliament would be better off without me" - insulting even more, the voters who put me there.

I can unequivocally guarantee that my challenge will remain unanswered.

This was not a light-hearted comment. His expression was serious, his body language was most aggressive and patronising and he made sounds and posed like a monkey or ape just before he sat down. This is the inescapable truth.

Khaiyum attempts to downplay the whole saga which he knows full well was a colossal PR failure by questioning why I did not raise this matter immediately after his obscene and racial slur. I can clarify now that the Parliament was in Committee debating the Heads of the Budget. The Speaker’s powers were curtailed as she left the Speaker’s Chair and assumed the role of a Chairperson. That is why there were no Points of Order. 

Sayed-Khaiyum himself stood up and pointed this out when a Member of the Opposition raised a Point of Order during saying this was a Committee so no point of order can be raised. 

Therefore Friday (20th November) was the first opportunity after the conclusion of the Budget process, available to me to raise this issue. 

No amount of fluffy explanation's can change the fact that Sayed-Khaiyum’s actions were a racist slur against me and the indigenous community, that we find deeply offensive. We are certainly not finding anything light-hearted about his antics.

That is why he must step down and it is as fundamental as that.

Manasa Talala, Seruvi Caqusau, Kelevi Sewatu, Penaia Drauna, Filise Vere, Viliame Vereivalu, Jona Davonu, Pita Matairavula and Senitiki Natakasavu are to be jointly charged with the Manslaughter of Vilikesa Soko and with Assault Occasioning Actual Bodily Harm to Senijieli Boila. The DPP has also decided to charge these same men with an alternative count of rape in regards to Vilikesa Soko. In addition, Manasa Talala and Viliame Vereivalu are also to be charged with Perverting the Course of Justice by instructing other police officers to make false statements in regard to this investigation...This case reinforces the commitment of the State to bring to justice any person who thinks that their position places them above the due process of the law." - The charges have been dropped and replaced with alternative count of rape because of Khaiyum's IMMUNITY CLAUSE in his 2013 Constitution of Fiji

Vilikesa Soko was arrested  in connection with a robbery from a foreign exchange store in Nadi. He later died in hospital. An autopsy revealed massive internal injuries and trauma consistent with previous alleged police assaults. He was not challenging the two dictators - Bainimarama and Khaiyum's iron-fist rule following 5 December, 2006 treasonous coup! Fijileaks had obtained and published the post-mortem report, below:

The former Police Commissioner Ben Groenewald after exiting Fiji but we must not shed too many tears for his sorry plight; every time Fijileaks exposed criminal wrongdoings and asked for his response, his standard reply was "I don't talk to Fijileaks" - he had absorbed "Fiji regime speak"

"In a press statement by the Department of Information on the 10th of November they indicated that I resigned due to personal and family reasons. The personal and family reasons mentioned is well known by the Public Service Commission and is related to housing issues.

We were accommodated in a Government Quarter, infected by mould and declared unfit by the Suva City Council for human occupation. Both my wife and I suffered with side effects and nothing was done about it. This was but one of the reasons why I submitted my request for an early release to the Office of the Constitutional Offices Commission.

I submitted my annual report ( as part of my contractual obligation) end May this year to the Secretary of the Constitutional Offices Commission, copied to my line Minister. In this report I highlighted issues that makes it difficult for me to act in accordance with my mandate as stipulated in section 129 of the Constitution and requested an audience.

The Commission was suppose to do a performance evaluation, linked to a performance based bonus payment. Until date no evaluation was done.

My first priority was to secure the 2014 General Election and to implement organisational and operational changes.

Unfortunately, internal resistance to change, a lack of political support to address critical shortage of recourses were some of the obstacles in not achieving all goals. I introduced more than 20 organisational and operational best practices of which most are not yet implemented.

Fiji’s past legacy and the reality that the Fiji Police Force was managed by Military Officer for more than 10 years, resulted in the Fiji Police Force being labelled as a brutal force by International and local Human Rights Organisations and Amnesty International.

I believe in the principles of modern policing set by Sir Robert Peel the founder of the British Metropolitan Police in 1892.

Peels most important proposition was that disorder is largely the result of ineffective policing and that the preservation of security and the maintenance of individual rights should be entrusted to specialist police officers rather than to military forces.

Prominent incidences such as the brutal assault on recaptured escapees, (the so called You-Tube case in 2012, victim, Iowane Benedito), the Vilikesa Soko murder in August 2014 and the illegal arrest of the songwriter, Mr Bilitake, in September 2014, indicated the unconstitutional involvement of individual military officers as main perpetrators.

In fact, Pita Matairavula, a previous body guard of the Prime Minister, was involved in all three cases.

During the investigation of the Bilitaki case I publicly announced that I will not tolerate any brutality or further Military interference in peacetime policing. This announcement was not well received by the Military management and after discussion with the then Commander and our line Minister we reached an agreement, how we would deal with future involvement of the Military in accordance with the applicable acts.

With reference to an incident of obstructing the police in arresting a military officer on a bench warrant we also reached an agreement, (however, not necessary in accordance with the law) that in future cases, where it would be necessary to execute an arrest in the military camp, the FPF would inform the Military operational room and they would assist through the Military Police.

An incident that played a prominent role in my decision to request my earlier release was indeed the way the Military command obstructing or perverting the course of justice in the You-Tube case.

On Monday 19 October, The Director Public Prosecutions (DPP) announced to charge three police officers and two military officers with sexual assault on Iowani Benedito (an indictable offence that authorised arrest without a warrant).

During an official meeting on Tuesday the 20th, where the Prime Minister, the Minister for Defence and the acting commander, RFMF, Brig. Gen. Mohammed were present, I informed about the decision by the DPP and that the FPF will arrest and process the five suspects for court appearance the next day.

With the exception of Pita Matairavula the other four suspects turned up at CID Head Quarters. They were criminally charged for an offence of sexual assault and produced in court on the 21st Oct.

Enquiries indicated that Matairavula was harboured in the Military camp and the investigation officer was informed by a senior officer at the military operational office that if he wanted to arrest Pita he must first call the Land Force Commander, Colonel Qiliho.

This was a breach of the agreement mentioned earlier, but being aware of the sensitivity of the case and the absence of the RFMF Commander I called Colonel Qiliho twice on the 21st, without answering or returning my call. I was later informed that he was also abroad.

As a second option I called the acting commander, Mohammed [Aziz] on three occasions on the 22nd and 23rd without any response. My PA left messages with his PA to contact me urgently. I also spoke to her on two occasions and informed her about the urgency of the case. During our last discussion she told me to speak to the RFMF legal advisor. We spoke on four occasions and he indicated that he has no authority to make any decision.

During the last discussion he informed me that Act. Commander Mohammed left the country and that I must speak to Commander Fox. I phoned him on two occasions on the 24th and 26th without any response.
I also phoned Min. Natuva on two occasions to update him on what is happening.

I consulted with the office of the DPP and requested a bench warrant, but was informed that Matairavula must appear in the High Court in Lautoka, for the Soko case, on the 29th and his office will arrange that he can be handed over to police after his court appearance.

At the court in Lautoka, Pita was accompanied by other military officers and the IO was refused to speak to Pita. To avoid confrontation, the IO decided not to arrest Pita.

He was again escorted by the military contingent and was harboured in the Suva Military camp until the 3rd of November. On Tuesday 3rd of November Matairavula was handed over to CIDHQ,, processed and taken to court. This was obviously done after the first four accused received bail.

This sequence of events constitute an offence of obstructing or perverting the course of justice in terms of section 190(b) of the Crimes Decree.

Taken the above into consideration both Col Qiliho and Commander Naupoto publicly denied that they were aware of incident.

Challenges:-

• Would the newly appointed Commissioner of Police, Brigadier-General Qiliho, open a criminal investigation and allow an independent and objective investigation against the military officers who obstructed the course of justice?

• Would ALL the implicated officers and other persons hand in their mobile phones for technical evaluation?

• Will the Government act in accordance with the Constitution and does not discriminate or take unlawful steps against those officers who investigate and perform their constitutional duties to uphold the rule of law.

In conclusion, I would like to thank all my loyal FPF colleagues, regional and international policing friends, other government departments and especially the community based crime prevention committees and individual members of the community for their support in our fight against crime.

I would also like to wish the acting Commissioner of Police all the best but as a word of caution, he must remember that a police force has much more disciplines to manage than the military and he must acquaint himself with all the decrees and regulations before making decisions. Peace time policing is a Police and not a military function!!!

'The allegation of assault against Mr Bilitaki is void of all truth '- Fiji Police Commissioner Ben Groenewald

STATEMENT FROM COMMISSIONER OF POLICE

"I am aware of the case of Mr Joseva Bilitaki and can confirm his arrest by a task team on Friday 26/09/14 at about 2230hrs.

He was detained at the Totogo Police Station for the alleged offence of annoyance which is in contravention to Section 376 of the Crimes Decree.

On Saturday 1500hrs Mr Bilitaki fell ill and was released and taken to the Colonial War Memorial Hospital where he received medical treatment for high blood pressure.

I visited him earlier today and he is in a satisfactory condition.

The allegation of assault against Mr Bilitaki is void of all truth.

I am urging people not to jump to conclusion on what they read on social media.

The case is under investigation and will be submitted to the Office of Director Public Prosecution once completed.

The interference of military personnel in policing issues is unacceptable and will be discussed with the relevant authority.

I am saddened that lighthearted comments and gestures I made during parliamentary exchanges on Wednesday have been deliberately twisted to imply that I made a racial slur against the i’Taukei.

Anyone who was in the parliamentary chamber who witnessed the full proceedings and read the Hansard report knows the truth: that I referred to the Opposition member, Honourable Ratu Isoa Tikoca, as Darth Vader because of the rumbling and menacing tone of his persistent interjections.

I went on to mimic Darth Vadar’s speaking style in the Star Wars movies by lowering the register of my voice and adopting a Darth Vadar pose. The video clip of the proceedings clearly shows members of the house laughing, including the Honourable Speaker, who specifically referred to me “breaking the ice”. At no stage does the Hansard record me saying anything that constitutes a racial slur. So I am very disappointed and saddened that Honourable Ratu Isoa has engaged in a pathetic attempt to vilify me using parliamentary privilege and inflame ethnic division.

Ordinary Fijians know that for my entire time in private and public life, I have fought racism and promoted the interests of every citizen, regardless of ethnicity, religious belief or where they come from in Fiji. It is simply inconceivable that I would be guilty of the accusation that is now being leveled against me. It is the cheapest of political shots and totally unjustified.

The fact that it took two days for the Honourable Ratu Isoa Tikoca to lodge a formal complaint with the Speaker raises serious questions about his own sincerity in this matter. If he was so insulted, why did he not say so immediately or even the following day? I believe that most Fijians will see this for what it is – a cynical attempt to exploit parliamentary exchanges between him and I to suggest a smear on the entire ethnic group to which he belongs.

Earlier in the week, the Honourable Tupou Draunidalo was forced to apologise to the House when she called a government member a “fool”. Was she implying that everyone of his ethnic background were also fools?

Honourable Ratu Isoa Tikoca is resorting to the old politics of looking for an ethnic dimension when the Opposition is losing public support and the Government is receiving widespread acclaim for the Budget from all Fijians.

OPPOSITION CHIEF WHIP TABLES CORRUPTION CLAIM DOCUMENTS IN PARLIAMENT

Opposition Whip Ratu Isoa Tikoca was today stopped from concluding a parliamentary point of order against racist ‘ape-like gestures’ and sounds made towards him by Finance Minister Khaiyum. But this was not before Ratu Isoa tabled documents that the Finance Minister challenged him to produce to support his claim of Mr Khaiyum’s alleged corruption.

In his intervention this morning, Hon Tikoca referred to the Acting Finance Minister’s racist ‘ape gestures’ directed at him in the Parliamentary Chamber. Ratu Isoa said that the Opposition office has received phone calls and emails from many indigenous and non indigenous Fijians who are angered by the Acting Prime Minister’s ‘ape’ performance.

Ratu Isoa said the actions of the Fiji First leader are completely unacceptable and have brought shame to parliament and besmirched the reputation of Fiji First. What he did is now being viewed by thousands around the world on YouTube.

He said it was an unprecedented display of outrageous parliamentary behaviour by an Acting Prime Minister to another member in Parliament. Nothing like this has ever happened before in the history of Fiji’s parliament. Ratu Isoa said that he had waited for a couple few days to allow the Acting Prime Minister time to withdraw his remarks and apologies but he had not done this. 

In a statement, Hon. Isoa Tikoca said that following Minister Khaiyum’s extraordinary and insulting behaviour people are throwing heated words and racial slurs at each other on social media. They see the Acting Prime Minister’s actions as racism. We must guard against racism. Highlighting ethnic concerns and issues is not racism. But making gestures which many have interpreted as a negative stereotype is a different story.

If he refuses to accept that people are angry and making complaints, he should look at his Ministry of Information’s own Facebook page and YouTube, and read the comments there. He might want to get his QORVIS PR consultant to read for himself what people are saying about the Acting Prime Minister’s racist ‘ape gestures’ in the house.

This issue will not die away. The Opposition plans to take further action until this matter is dealt with properly and will follow up on the corruption documents tabled by Ratu Isoa.
